Article 28. Protection of information constituting state secrets in case of changes in the forms of ownership and functions of subjects of legal relations Chapter 7. Protection of State secrets of the Law on State Secrets
1. State bodies and organizations in possession of information constituting state secrets, in cases of changes in their functions, forms of ownership, liquidation or termination of work using information constituting state secrets, are obliged to take measures to ensure the protection of this information and its carriers. At the same time, the media of information constituting state secrets are destroyed, archived or transferred in accordance with the established procedure.:
to the legal successor of a state body or organization that has information constituting state secrets, if this legal successor has the authority to carry out work using the specified information.;
to the state body, which, according to Article 15 of this Law, has the relevant information at its disposal.;
to another state body or organization by decision of the authorized state body for the protection of state secrets of the Republic of Kazakhstan.
2. The procedure for the protection of information constituting state secrets in the event of changes in the forms of ownership and functions of subjects of legal relations is determined by the Government of the Republic of Kazakhstan.
The Law of the Republic of Kazakhstan dated March 15, 1999 No. 349-1.
This Law defines the legal framework and a unified system for the protection of state secrets in the interests of ensuring the national security of the Republic of Kazakhstan, regulates public relations arising in connection with the classification of information as state secrets, their classification, disposal, protection and declassification.
