Article 10. The concepts of crime and criminal misconduct  The Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan

 

1. Criminal offenses, depending on the degree of public danger and punishability, are divided into crimes and criminal offenses.

2. A crime shall be deemed to be a socially dangerous act (action or omission) committed guiltily, prohibited by this Code under threat of punishment in the form of a fine, correctional labor, community service, restriction of liberty or imprisonment.

3. A criminal offense is an act committed guiltily (action or omission) that does not pose a great public danger, has caused minor harm or has created a threat of harm to a person, organization, society or the state, for which punishment is provided in the form of a fine, correctional labor, community service, arrest, expulsion from the Republic of Kazakhstan. a foreigner or a stateless person.

4. An action or omission is not a criminal offense, although it formally contains signs of an act provided for by A special part of the present Code, but due to its insignificance, it does not pose a public danger.
