Article 11. The procedure for the examination of the application Chapter 3. Trademark examination of the Law on Trademarks, Service Marks, Geographical Indications and Names of Places of Origin of Goods

     1. The examination of the application is carried out in stages:

     1) preliminary examination – within one month from the date of application submission;

     2) a full examination, during which the conformity of the claimed designation with the requirements established by Articles 6 and 7 of this Law is verified, within seven months from the date of filing the application.

     2. At any stage of the examination, the expert organization has the right to request additional materials, which must be submitted within three months from the date of sending the request to the applicant.

     If the applicant fails to submit additional materials or requests for an extension of the specified period within the prescribed period, the office work is terminated and the application is considered withdrawn.

     3. Information on the course of consideration of the application is not provided to third parties, except in cases established by the laws of the Republic of Kazakhstan.

     This Law regulates relations arising in connection with the registration, legal protection and use of trademarks, service marks, geographical indications and names of places of origin of goods in the Republic of Kazakhstan.
