Article 42. Creation, reorganization and liquidation of educational organizations The Law on Education
1. The creation, reorganization and liquidation of educational organizations, including the creation, reorganization and liquidation by organizations of higher and (or) postgraduate education of legal entities in scientific and educational activities, are carried out in accordance with the legislation of the Republic of Kazakhstan.
The reorganization of organizations of higher and (or) postgraduate education established as commercial organizations into non-profit organizations is carried out in accordance with the procedure established by the Law of the Republic of Kazakhstan "On Non-Profit Organizations".
2. In case of deprivation of a license to engage in educational activities or liquidation of an educational organization, its founder(s) shall take measures to transfer students to continue their studies in other educational organizations.
The requirements of the first part of this paragraph do not apply to organizations of higher and (or) postgraduate education.
3. In cases of deprivation (revocation), termination of the license and (or) the appendix to the license to engage in educational activities, or liquidation of an organization of higher and (or) postgraduate education, its founder(s) within two months from the date of the decision to revoke (revoke), termination of the license and (or) the appendix to the license provides:
1) transfer of students to continue their studies and transfer of their personal files to other organizations of higher and (or) postgraduate education;
2) transfer of personal files of persons who have not completed their education or have not passed the final certification, as well as personal files and copies of educational documents of persons who have completed their studies at an educational organization in previous years, to the appropriate state archive.

This Law regulates public relations in the field of education, defines the basic principles of state policy in this field and is aimed at ensuring the constitutional right of citizens of the Republic of Kazakhstan, as well as foreigners and stateless persons permanently residing in the Republic of Kazakhstan, to education.
