Article 279. Environmental requirements for the conservation and liquidation of facilities for the exploration and (or) production of hydrocarbons of the Environmental Code of the Republic of Kazakhstan

Article 279. Environmental requirements for the conservation and liquidation of facilities for the exploration and (or) production of hydrocarbons of the Environmental Code of the Republic of Kazakhstan

     1. Conservation or liquidation of facilities for the exploration and (or) production of hydrocarbons at sea, exploration, including solid minerals, mineral and (or) drinking waters, is carried out in accordance with the legislation of the Republic of Kazakhstan on subsoil and subsoil use.

     2. In the case of conservation of wells after completion of the tests, the subsurface user is obliged to carry out conservation work, ensure the safety of the drilling base and reliable sealing of the well until the resumption of work.

     3. During the liquidation of wells drilled from a bulk base (underwater berm or island), the subsurface user is obliged to ensure their sealing and monitoring of the condition of the artificial base, having previously cleaned it from possible contamination with hydrocarbons and other chemicals. In case of erosion of an island (berm), the subsurface user is obliged to mark it (her) with a milestone or buoy before the final leveling of the base is carried out and transfer the coordinates to authorized state bodies for the study of subsurface and inland waterway transport for application on nautical charts in order to ensure the safety of navigation.

     4. When liquidating wells drilled from platforms of any type, the platform structures must be completely dismantled and removed, and the heads of sealed wells cut off at the bottom level to avoid interfering with fishing, fish farming and shipping.

     5. The decision on the liquidation of bulk mining islands decommissioned should be made on the basis of an assessment of the environmental impact of the liquidation work.

     6. Conservation and liquidation of flooded and flooded old wells must be carried out according to projects that have passed state environmental expertise and expertise conducted in accordance with the legislation of the Republic of Kazakhstan on subsoil and subsoil use. At the same time, a plan must be developed and approved to ensure preparedness and response to oil spills at sea, in inland waters and in the safety zone of the Republic of Kazakhstan, and monitoring of canned and liquidated wells must be ensured. It is not allowed to carry out work without providing them with the necessary resources to eliminate oil spills at sea, inland bodies of water and in the safety zone of the Republic of Kazakhstan in accordance with the plan for preparedness and action to eliminate oil spills at sea, inland bodies of water and in the safety zone of the Republic of Kazakhstan.
