Article 130. The right of citizens to non-procedural detention of persons who have committed a criminal offense CPC RK Code of Criminal Procedure of the Republic of Kazakhstan

Article 130. The right of citizens to non-procedural detention of persons who have committed a criminal offense CPC RK Code of Criminal Procedure of the Republic of Kazakhstan

     1. The victim, as well as any other citizen, have the right to detain a person who has committed a criminal offense and restrict his freedom of movement for transfer or delivery to a criminal prosecution body or other public authority in order to prevent him from committing other encroachments.

     2. In the cases provided for in the first part of this article, physical force and other means may be used against a detained person when resisting them, within the limits provided for in Article 33 of the Criminal Code of the Republic of Kazakhstan. If there is reason to believe that the detained person is carrying weapons or other dangerous items relevant to the criminal case, the citizen who detained him has the right to inspect the detainee's clothes and seize the items in his possession for transfer to law enforcement agencies or another public authority.
