Article 38. Protection from harmful effects of aircraft flights The Law on the Use of the Airspace of the Republic of Kazakhstan and Aviation Activities
1. A civil aircraft intended for operation in the Republic of Kazakhstan is certified by an authorized organization in the field of civil aviation for compliance with the requirements of the International Civil Aviation Organization (ICAO) regarding noise on the ground with the issuance of a noise certificate, which is an appendix to the certificate of airworthiness of a civil aircraft.
Certification and issuance of a noise certificate is carried out in accordance with the Rules for Certification and issuance of a certificate of airworthiness of a civil aircraft of the Republic of Kazakhstan.
The owners of airfields (heliports), operators, commanders and crew members of aircraft are obliged to prevent unnecessary noise or minimize it when operating aircraft on the ground and in the air.
2. It is prohibited to drop substances or other wastes and materials harmful to human health and the environment from aircraft, with the exception of agricultural aviation operations performed in compliance with public and environmental safety measures, combat training and combat flights of state aviation, or in the event of a clear threat to flight safety and the prevention of an aviation accident..
In order to prevent harmful effects of aircraft on humans, animals and the environment in specific areas, an emergency aircraft departure zone, a fuel discharge zone or in-flight fuel production zone may be established, where a minimum flight altitude is provided, uniform for all aircraft, or separately by aircraft type.
3. Flights of aircraft in the airspace of the Republic of Kazakhstan at supersonic speed must be performed at altitudes that exclude the harmful effects of sound impact on the environment, according to general rules, or in areas remote from populated areas that are designated specifically for supersonic flights.

This Law regulates public relations related to the use of the airspace of the Republic of Kazakhstan and aviation activities, and defines the procedure for the use of airspace and aviation activities in order to protect human life and health, the environment, the interests of the state, ensure the safety of aircraft flights and meet the needs of the economy of the Republic of Kazakhstan, individuals and legal entities in aviation services.
