Article 115. Protection of the rights and interests of orphaned children, children left without parental care of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan
1. Protection of the rights and interests of orphaned children, children left without parental care, is entrusted to the authorized body in the field of protection of children's rights of the Republic of Kazakhstan and other state bodies within their competence, as well as to the legal representatives of these children.
2. The organization of activities for the registration of orphaned children and children left without parental care, based on the specific circumstances of the loss of parental care, the choice of the form of placement of children, as well as subsequent control over the conditions of detention, upbringing and education are entrusted to local executive bodies.
3. Mediation and any other activity of individuals and legal entities in the selection, placement, transfer of orphaned children, children left without parental care is prohibited, with the exception of state bodies within their competence.
The activities of bodies performing guardianship or trusteeship functions and other organizations performing their duties to identify and place orphaned children, children left without parental care, functions to protect children's rights, as well as the activities of agencies and organizations to assist in the placement of orphaned children are not considered mediation activities. children left without parental care to families of citizens of the Republic of Kazakhstan, provided for by this Code.
Individuals and legal entities specified in this article may not pursue commercial goals in their activities.
