Article 353. Violation of the procedure for the liquidation and conservation of subsurface use facilities The Code of the Republic of Kazakhstan on Administrative Offences
1. Failure to fulfill the obligation to eliminate the consequences of conducting subsurface use operations within the time limits established by the legislation of the Republic of Kazakhstan on subsurface and subsurface use, –
entails a fine for small businesses or non–profit organizations in the amount of thirty, for medium–sized businesses - in the amount of fifty, for large businesses - in the amount of one hundred and fifty monthly calculation indices.
2. Conducting operations for exploration and extraction of solid minerals, extraction of common minerals, use of subsurface space and prospecting, the elimination of the consequences of which is not ensured in accordance with the requirements of the Code of the Republic of Kazakhstan "On Subsurface and Subsoil Use", –
entails the suspension of activities at the relevant site or subsurface areas for a period of three months.
3. Failure by a subsurface user to eliminate a violation of the requirement provided for in part two of this article during the period of suspension of activity at the relevant site or subsurface areas −
entails the prohibition of activities (subsurface use operations) in the relevant area or subsurface areas.
