Article 67. Violation of the procedure and conditions of serving a sentence in the form of restriction of freedom of the Criminal Executive Code of the Republic of Kazakhstan

Article 67. Violation of the procedure and conditions of serving a sentence in the form of restriction of freedom of the Criminal Executive Code of the Republic of Kazakhstan

     1. Violation of the order and conditions of serving a sentence in the form of restriction of liberty is:

     1) failure to perform the duties specified in the first part of Article 66 of this Code;

     2) intentional damage (spoilage) of electronic tracking devices;

     3) the commission of administrative offenses that infringe on the rights of the individual, the rights of minors, family and domestic relations, public order and morality, for which an administrative penalty has been imposed on the convicted person.

     2. Malicious violations of serving a sentence in the form of restriction of freedom are:

     1) repeated commission within a year of the violations specified in the first part of this Article;

     2) departure from the Republic of Kazakhstan;

      3) the commission by a convicted person of a criminal offense, including a repeat offense, if the pre-trial proceedings are terminated on the basis of part one of Article 65, parts one and three of Article 68, parts two and four of Article 78 of the Criminal Code of the Republic of Kazakhstan;

     4) refusal to comply with legal requirements, as well as insulting or threatening violence against a probation officer;

     5) hiding from probation control;

      6) evasion from performing forced labor without valid reasons specified in subparagraph 1) of the third part of Article 60 of this Code.

     3. A convicted person is considered to be hiding from probation control if his location has not been established for more than fifteen days from the date of his failure to register with the probation service.
