Article 602. Grounds for transferring persons sentenced to imprisonment to serve their sentences or persons suffering from mental disorders for compulsory treatment in the State of which they are citizens CPC RK Code of Criminal Procedure of the Republic of Kazakhstan
On the basis of an international agreement between the Republic of Kazakhstan and the relevant foreign State or the agreement reached on the basis of the principle of reciprocity between the Prosecutor General of the Republic of Kazakhstan and the competent authorities and officials of a foreign state, their citizenship may be transferred to the State of their nationality.:
1) a foreigner sentenced to imprisonment by a court of the Republic of Kazakhstan, as well as a citizen of the Republic of Kazakhstan sentenced to imprisonment by a court of a foreign state, for further serving his sentence;
2) a foreigner who has committed a socially dangerous act in the territory of the Republic of Kazakhstan in a state of insanity or who has become ill after committing a criminal offense with mental disorders that make it impossible to impose or execute punishment, in respect of whom there is a court decision of the Republic of Kazakhstan on the application of compulsory medical measures to him, as well as a citizen of the Republic of Kazakhstan, a person who commits a socially dangerous act on the territory of a foreign state in a state of insanity or who becomes ill after committing a criminal offense with mental disorders that make it impossible to impose or execute punishment, in respect of whom there is a court decision of a foreign state on the application of compulsory medical measures to him, – for further compulsory treatment.
