Article 145. Conditions of serving a sentence in institutions of complete security of the Criminal Executive Code of the Republic of Kazakhstan
1. Those sentenced to imprisonment in institutions of complete security are kept in cells.
Upon the written application of the convicted person, as well as in cases of a threat to the personal safety of the convicted person or the need to isolate the convicted person, endangering the life and health of other convicts or the staff of the institution, by reasoned order of the head of the institution and with the consent of the prosecutor, such convicts are kept in solitary cells.
For the detention of convicts who pose a threat, as well as convicts in respect of whom there is a threat to personal safety, cells with greater occupancy can be used.
Transfer to solitary cells at the request of convicted persons is carried out if there are available solitary cells.
2. The placement of convicted persons in cells is carried out in compliance with the requirements provided for in Article 94 of this Code.
Convicts who are in strict, ordinary and facilitated conditions of serving their sentences are kept separately.
Convicts who are sent to full-security institutions to perform household maintenance work are kept in isolation from other convicts.
3. Convicts' walks are carried out during the daytime on a specially equipped outdoor part of the territory.
4. Convicts serving their sentences in strict conditions have the right to:
1) spend monthly on the purchase of food and basic necessities the funds available in the cash control accounts of the temporary placement of money, in the amount of up to two monthly calculation indices;
2) receive one parcel or transfer and one parcel per year;
3) have two short-term dates during the year;
4) Enjoy a one-hour daily walk.
5. Convicts serving their sentences under normal conditions have the right to:
1) spend monthly on the purchase of food and basic necessities the funds available in the cash control accounts of the temporary placement of money, in the amount of up to five monthly calculation indices;
2) receive two parcels or transfers and two parcels during the year;
3) have two short-term and one long-term dates during the year;
4) enjoy a daily walk lasting an hour and a half.
6. Convicts serving sentences in light conditions have the right to:
1) spend monthly on the purchase of food and basic necessities the funds available in the cash control accounts of the temporary placement of money, in the amount of up to seven monthly calculation indices;
2) receive three parcels or transfers and three parcels during the year;
3) have three short-term and three long-term dates during the year;
4) Enjoy a two-hour daily walk.
