The calculation of the specified time limits begins at 00.01 hours of the day, during which the immigrant crossed the State Border of the Republic of Kazakhstan or arrived at the receiving person. Registration of immigrants is carried out according to identity documents.
The objective side of part 2 of the commented article is expressed by illegal actions (inactions) that violate the legislation of the Republic of Kazakhstan in the field of population migration and is characterized by qualifying signs:
1) stay in the Republic of Kazakhstan without registration with the internal affairs bodies for more than three days after the expiration of five calendar days;
2) residence not at the address in the Republic of Kazakhstan indicated during registration;
3) non-compliance with the rules of transit through the territory of the Republic of Kazakhstan.
On the basis of the Law of the Republic of Kazakhstan dated July 22, 2011 No. 477-IV "On Population Migration", the rules for transit passage of foreigners and stateless persons are determined by the internal affairs bodies of the Republic of Kazakhstan jointly with the Ministry of Foreign Affairs of the Republic of Kazakhstan in coordination with the National Security Committee of the Republic of Kazakhstan (art.

The Regulatory resolution of the Supreme Court of the Republic of Kazakhstan dated October 6, 2017 No. 7 "On some issues of the application by courts of the norms of the Special Part of the Code of Administrative Offences of the Republic of Kazakhstan" explains the specifics of the stay of citizens of the Russian Federation and the countries of the EAEU Customs Union (Eurasian Economic Union).
Article 1 of the Agreement between the Republic of Kazakhstan and the Russian Federation on the Procedure for the Stay of Citizens of the Republic of Kazakhstan on the Territory of the Russian Federation and Citizens of the Russian Federation on the Territory of the Republic of Kazakhstan (Astana, June 7, 2012, ratified by the Law of the Republic of Kazakhstan dated November 14, 2014 No. 250-V, entered into force on January 23, 2015) establishes that citizens of the Russian Federation Upon entry into the territory of the Republic of Kazakhstan, the Russian Federation is exempt from the registration obligation within 30 days from the date of entry. In case of a stay of more than 30 days, these citizens are required to register with the competent authorities of the Republic of Kazakhstan.
In accordance with paragraph 17 of the Rules of Entry and Stay of Immigrants, citizens of 45 states enter the Republic of Kazakhstan and leave the Republic of Kazakhstan without a visa, if the period of their stay in the Republic of Kazakhstan does not exceed 30 calendar days from the moment of crossing the State border of the Republic of Kazakhstan. At the same time, the same persons can enter Kazakhstan on a visa. If the validity period of the visa expires before the period of the visa-free stay, such a person has the right to use the remaining days of the visa-free stay. However, both of these terms are calculated in parallel and cannot be added together.
For example, a U.S. citizen entered the territory of the Republic of Kazakhstan on January 28, 2017 with a visa expiration date of January 30, 2017. In accordance with paragraph 17 of the Rules of Entry and Stay of Immigrants, this citizen has the right to stay in the territory of the Republic of Kazakhstan for 30 calendar days without a visa, that is, from January 28 to February 26, 2017.
However, if a foreigner entered on January 1, 2017, and the visa expired on February 2, 2017, such a person cannot use an additional 30 calendar days of visa-free travel, as this period is absorbed by the duration of the visa stay.
The objective side of part 3 of the article under study provides for a violation by a foreigner or a stateless person of the legislation of the Republic of Kazakhstan in the field of population migration, which resulted in non-departure from the Republic of Kazakhstan within three days after the expiration of the period specified in the visa or upon registration in the migration card.
Paragraph 3 of Article 1 of the Law of the Republic of Kazakhstan dated July 22, 2011 No. 477-IV "On Population Migration" defines the concept of a visa. An entry and exit permit (hereinafter referred to as a visa) is a mark made by authorized state bodies of the Republic of Kazakhstan in a migrant's passport or a document replacing it, which grants the right to enter the territory of the Republic of Kazakhstan, travel through its territory, stay there and leave the territory of the Republic of Kazakhstan for a time, for the purposes and on the terms, specified in the visa.
The permitted period of stay of immigrants in the Republic of Kazakhstan ends upon the expiration of the visa or registration period specified in the migration card or certificate of temporary registration of an immigrant or an attachment to the passport of registration of an immigrant. The extension of the registration period is made out by an appropriate mark in the migration card affixed by the internal affairs bodies, or by a certificate of temporary registration of an immigrant or an insert to the passport of registration of an immigrant.
In accordance with paragraph 17 of the Order of the Minister of Internal Affairs of the Republic of Kazakhstan dated January 27, 2016 No. 83, migration cards are not issued.:
1) persons with visas of the Republic of Kazakhstan, as well as persons with diplomatic and official passports and confirmation of the status of an "investor" from an authorized body;
2) persons under the age of 16;
3) crew members of air, sea and river vessels;
4) employees of train crews, including refrigerated, locomotive and persons accompanying goods traveling by rail;
5) passengers of trains passing through the territory of the Republic of Kazakhstan;
6) drivers of vehicles engaged in international road transport.
In case of violation of the terms and procedure of stay of immigrants in the territory of the Republic of Kazakhstan, if the delay in departure occurred for reasons beyond their control (in case of natural and man-made emergencies, violations of the normal operation of transport), immigrants are allowed to cross the border with an appropriate mark in the migration card.
Migration cards are presented at border control along with a passport. Migration cards are kept by the immigrant before leaving the Republic of Kazakhstan and are presented at the request of employees of the internal affairs bodies and the border guard service. The registration mark with the internal affairs bodies is made by employees of the migration service, as well as through the visa and migration portal of the UIS Berkut through a personal digital electronic signature through the websites vmp.gov.kz or e.gov.kz . Persons whose stay in the Republic of Kazakhstan does not exceed 5 calendar days are not required to register their passports with the internal affairs bodies.
The objective side of part 4 of the analyzed article is expressed in unlawful intentional inaction, expressed in avoiding departure for a period exceeding three days after the expiration of the period specified in the visa or during registration in the migration card.
In accordance with paragraph 6 of Resolution No. 148 of the Government of the Republic of Kazakhstan dated January 21, 2012, the permitted period of stay of immigrants in the Republic of Kazakhstan ends upon the expiration of the visa or registration period specified in the migration card or certificate of temporary registration of an immigrant or the attachment to the passport on registration of an immigrant.
When a court makes a decision on the expulsion of foreigners and stateless persons, they may be held in special institutions of the internal affairs bodies for the period necessary to organize the expulsion.
The issue of liability for violations of the order of stay by immigrants enjoying privileges and immunities, in accordance with the legislation of the Republic of Kazakhstan and international treaties ratified by the Republic of Kazakhstan, as well as the reduction of their stay in the territory of the Republic of Kazakhstan is resolved through diplomatic channels.
The objective side of part 5 of the commented article is expressed as a violation of the legislation of the Republic of Kazakhstan in the field of population migration, and is expressed by two qualifying signs:
1) non-compliance of the activities carried out with the purposes specified in the visa and (or) when registering in the migration card;
2) carrying out work in the Republic of Kazakhstan without obtaining a work permit, when obtaining such a permit is a necessary condition for carrying out work.
The rules of entry and exit of migrant workers are regulated by the Decree of the Government of the Republic of Kazakhstan dated January 21, 2012 No. 148.
Immigrants temporarily staying in the Republic of Kazakhstan are not allowed to work without appropriate permits issued by the local executive body or internal affairs bodies, unless otherwise provided by the legislation of the Republic of Kazakhstan in the field of population migration and/or international treaties ratified by the Republic of Kazakhstan (paragraph 7).
Immigrants arriving for the purpose of employment are divided into the following categories::
1) foreign workers are immigrants who have arrived or are employed by employers to work in the territory of the Republic of Kazakhstan, including as part of an intra–corporate transfer;
2) business immigrants – immigrants who arrived for the purpose of carrying out entrepreneurial activities in accordance with the legislation of the Republic of Kazakhstan;
3) seasonal foreign workers are immigrants employed by employers to perform seasonal work that, due to climatic or other natural conditions, is performed during a certain period (season), but not more than one year.;
4) labor immigrants – immigrants who arrived in the Republic of Kazakhstan as domestic workers in order to perform work (provide services) for individual employers in the household on the basis of a permit to a labor immigrant (paragraph 17).
The procedure for monitoring the stay of labor migrants is carried out in accordance with the Order of the Minister of Internal Affairs of the Republic of Kazakhstan dated February 8, 2014 No. 76 "On approval of the Rules for issuing, extending and Revoking permits for labor immigrants, as well as registration, formation and maintenance of data and photo records of labor immigrants." The maximum period of a work permit for an immigrant may not exceed twelve months (paragraph 3).
The grounds for revoking a work permit for an immigrant are:
1) carrying out work activities not related to the performance of work (provision of services) for individual employers in the household as domestic workers;
2) the presence of a medical condition in the migrant worker that prevents him from working in the chosen specialty specified in the employment contract;
3) violation by a labor immigrant of the current legislation of the Republic of Kazakhstan (paragraph 23).
The objective side of Part 6 is characterized by illegal actions (omissions) provided for in parts one and three of this article, committed repeatedly within a year after the imposition of an administrative penalty.
The objective side of Part 7 is characterized by illegal actions (omissions) provided for in parts two, four and five of this article, committed repeatedly within a year after the imposition of an administrative penalty.
Paragraph 21 of the Regulatory Resolution of the Supreme Court of the Republic of Kazakhstan dated October 6, 2017 No. 7 clarifies the specifics of the repeated commission of the offense provided for in parts 1-5 of this Article. The sixth part of Article 517 of the Administrative Code provides for administrative liability for acts provided for in parts one and three of this Article, committed repeatedly within a year after the imposition of an administrative penalty. Also, part seven of Article 517 of the Administrative Code provides for administrative liability for acts provided for in parts two, four and five of this article, committed repeatedly within a year after the imposition of an administrative penalty. For the presence of the composition of these offenses, the simultaneous totality of all the acts listed in the disposition of the article is optional.
In this case, a repetition is formed when the same person commits any of the actions listed in the disposition of part six or seven of Article 517 of the Administrative Code, respectively. The newly committed act may not be identical to the one for which the person was brought to administrative responsibility during the year. For example, a migrant who was previously brought to administrative responsibility under the second part of Article 517 of the Administrative Code for staying in Kazakhstan without registration with the internal affairs bodies beyond the time limits provided for in the first part of this article, if he subsequently found out that he did not live at the address indicated in the registration, or evaded departure for a period exceeding three days after the expiration of the period specified in the visa or upon registration in the migration card is subject to liability under part seven of this article.
The subjects of the offense in all parts of the article under study are foreign citizens and stateless persons residing in the Republic of Kazakhstan.
The legal status of foreigners and stateless persons is regulated by the Law of the Republic of Kazakhstan dated June 19, 1995 "On the legal status of foreigners", as well as regulatory legal acts of the Government of the Republic of Kazakhstan.
