Article 43-2. The procedure for issuing a permit to a labor immigrant The Law on Population Migration
1. A work permit is issued to a labor immigrant for the period specified in the permit application and may range from one to twelve months.
The maximum period of a work permit for an immigrant may not exceed twelve months.
A new work permit is issued to a labor immigrant before the expiration of the previous permit.
A work permit is issued to a labor immigrant upon presentation of documents confirming the legality of his stay in the territory of the Republic of Kazakhstan, as well as payment of an advance payment on individual income tax for the period specified in the permit application.
2. At the request of a labor immigrant, the permit for a labor immigrant is repeatedly extended for the period specified in the application, and may be one, two or three months.
The permit for a labor immigrant is extended upon presentation of documents confirming the performance of work (provision of services) by individual employers in the household in the previous period, as well as the payment of an advance payment on individual income tax for the period for which the permit is extended to a labor immigrant.
3. The procedure for issuing, extending and revoking a work permit for an immigrant is determined by the authorized body on migration issues.
3-1. It was valid until 01.01.2024 in accordance with the Law of the Republic of Kazakhstan dated 29.06.2021 No. 58-VII.
4. Permission to an immigrant worker is the basis for an immigrant to conclude an employment contract for the performance of work (provision of services) from individual employers in the household.
5. It is not allowed to conclude employment contracts for the performance of work (provision of services) in a household by one individual employer at the same time with more than five labor immigrants.
6. A permit for a labor immigrant grants the right to a labor immigrant to perform work (provide services) in the household of an individual employer in the territory of the administrative–territorial unit in which it was issued.
