Article 11. Restrictions on the payment of the State premium on contributions to housing construction savings of the Law on Housing Construction Savings in the Republic of Kazakhstan

1. The State award is subject to refund to the budget in the following cases::

1) (deleted - dated July 2, 2007, No. 272 (for the procedure of entry into force, see art. 2);

2) misuse of the housing loan by the depositor;

2-1) repayment of the loan within fourteen calendar days from the date of issue of the loan if the money has been accumulated for less than three years;

3) making payments of the state premium by the housing construction savings bank to the depositor in violation of this Law and (or) the housing construction savings agreement. At the same time, the amount (part of the amount) of the state premium paid by the housing construction savings bank with violations is subject to refund.;

4) early termination by the parties of the agreement on housing construction savings when the term of accumulation of deposits in the housing construction savings bank is less than three years;

5) assignment of rights by the depositor under the housing construction savings agreement to a person who is not a citizen of the Republic of Kazakhstan;

6) the discovery by the central authorized body for budget execution of the payment of state premiums to one depositor on two or more accounts for deposits in housing construction savings in several housing construction savings banks. At the same time, the state premium accrued in previous years is subject to refund to the budget, with the exception of premiums accrued on one of the contributions to housing construction savings at the depositor's choice.

2. The State award is not subject to refund to the budget in the following cases::

1) assignment of rights by a depositor under a housing construction savings agreement or pledge by him of the rights to receive housing construction savings and (or) housing loans, interim housing and preliminary housing loans to another person who is a citizen of the Republic of Kazakhstan, with the written permission of the housing construction savings bank;

2) death or total disability of the depositor;

3) when, after the conclusion of the housing construction savings agreement, the depositor is registered as unemployed in accordance with the procedure established by the legislation of the Republic of Kazakhstan, and remains so for six months continuously by the time the state bonus is paid.;

4) in the cases provided for by paragraph 3 of Article 12 of this Law.
