Article 20. Protective order The Law on the Prevention of Domestic Violence
1. In order to ensure the safety of the victim and in the absence of grounds for administrative detention in accordance with the procedure provided for by the Code of the Republic of Kazakhstan on Administrative Offences, or detention in accordance with article 128 of the Criminal Procedure Code of the Republic of Kazakhstan, the heads of the territorial police authority or their deputies, district police inspectors, inspectors for minors and for the protection of women from A protective order is issued, taking into account the opinion of the victim, which is handed over to the person for execution., the perpetrator of domestic violence or who threatens to commit it, against receipt. In case of refusal to sign, a record of this is made in the protective order.
The victim must be provided with a copy of the protective order against receipt on the day of its issuance, explaining his rights, as well as the legal consequences in case of violation of the protective order by the person against whom it was issued.
A copy of the protective order is sent to the prosecutor within twenty-four hours from the date of its delivery to the person against whom it was issued.
2. A protective order is issued against a sane person who has reached the age of sixteen at the time of its issuance.
3. The Protective order prohibits the commission of domestic violence, against the will of the victim to seek out, harass, visit, conduct oral, telephone conversations and contact him in other ways, including minors and (or) incapacitated members of his family.
4. The protective order specifies: the time and place of its issuance, by whom and against whom it was issued, the place, time and circumstances of the commission or threat of domestic violence, the established restrictions in relations with the victim, the legal consequences in cases of continued illegal actions and violations of the protective order.
5. The period of validity of a protective order is thirty days from the date of its delivery to the person in respect of whom it was issued. The frequency of the check is at least once every seven calendar days.
6. Excluded by the Law of the Republic of Kazakhstan dated 02/18/2014 No. 175-V (effective ten calendar days after the date of its first official publication).
7. Violation of the protective order entails liability established by the Code of the Republic of Kazakhstan on Administrative Offenses.
8. The person in respect of whom a protective order has been issued is placed on preventive register by the internal affairs bodies and preventive control is carried out over him.

This Law defines the legal, economic, social and organizational bases of the activities of state bodies, local governments, organizations and citizens of the Republic of Kazakhstan for the prevention of domestic violence.
