As a result of establishing the child's origin, mutual rights and obligations arise between the father (mother) and the child.

By virtue of article 27 of the Constitution of the Republic of Kazakhstan, marriage, family, fatherhood and childhood are protected by the State. Taking care of children and their upbringing is the natural right and responsibility of parents. According to article 21 of the Law, every child has the right to live and be raised in a family, the right to know his parents and other close relatives, and the right to their care and upbringing, except in cases where this is contrary to his interests. The origin of the children, certified in accordance with the procedure established by law, is recognized as the basis for the rights and obligations of parents and children. Establishing the origin of children should be understood as a way to protect the rights of minors, aimed at restoring (recognizing) violated (disputed) rights of the child. Based on a court decision, the civil registration authorities (hereinafter referred to as the RAGS) make an entry in the civil registration book, make changes to the record of the child's birth certificate, and issue a new birth certificate (the previously issued one is canceled).  As a result of establishing the child's origin, mutual rights and obligations arise between the father (mother) and the child. The establishment of the child's origin is carried out by the court in the order of a claim or special legal proceedings.
