Article 94. Adoption of a child without parental consent of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan

Article 94. Adoption of a child without parental consent of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan

     The consent of the child's parents for adoption is not required if they:

     1) unknown or declared dead by the court, recognized as missing;

     2) declared legally incompetent by the court;

     3) deprived of parental rights by the court;

     4) do not live together with the child and evade his upbringing and maintenance for more than six months for reasons deemed disrespectful by the court.

     If there is a written application for the abandonment of a child in the medical organization of an unmarried mother in accordance with the procedure established by the legislation of the Republic of Kazakhstan, the court does not have the right to demand other documents confirming the consent of the parents to adoption.
