Article 190. Application for State registration of the birth of a child of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan
1. An application for state registration of the birth of a child is submitted by the parents or one of them, and in case of their death, illness or inability for other reasons to make an application – by interested persons or the administration of the medical organization where the mother was at the birth of the child. Copies of the identity document of a foreigner or stateless person, if the parents or one of them is a foreigner or a stateless person, a certificate of marriage (matrimony), if the marriage (matrimony) was concluded outside the Republic of Kazakhstan, are attached to the application for state registration of the birth of a child.
If other persons than the parents have applied for state registration of the child's birth, then these persons must provide an identity document of the applicant, as well as a document confirming his authority to register the child's birth.
In case of state registration of two or more children, an application is submitted for each separately.
Submission of an application for state registration of a child's birth is not required when carrying out state registration of a child's birth through a proactive service of the applicant's choice in accordance with the Law of the Republic of Kazakhstan "On State and Socially Responsible Services".
A foreigner or a stateless person permanently residing in the territory of another State, along with presenting identification documents, shall submit a notarized translation of their text in Kazakh or Russian.
The accuracy of the translation of the text of the documents certifying the identity of a foreigner or a stateless person can be certified at the diplomatic mission or consular institution or at the foreign ministry of the State of which the foreigner is a citizen or the State of permanent residence of the stateless person.
2. When applying to the Government for Citizens State Corporation or through the Digital Government web portal, an application for state registration of a child's birth is submitted in accordance with a subordinate regulatory legal act defining the procedure for the provision of public services.
