Article 100. Unpaid leave to care for a child until he reaches the age of three years of the Labor Code of the Republic of Kazakhstan

Article 100. Unpaid leave to care for a child until he reaches the age of three years of the Labor Code of the Republic of Kazakhstan  

     1. An employer is obliged to grant unpaid leave to an employee to care for a child until he reaches the age of three.:

     1) at the choice of the parents – the mother or the father of the child;  

     2) the parent who is raising the child alone;

     3) another relative who is actually raising a child who has been left without parental care, or a guardian;

     4) an employee who adopted a newborn child (children).

     2. Unpaid leave to care for a child until the age of three is granted on the basis of a written application from the employee indicating its duration and providing a birth certificate or other document confirming the fact of the child's birth.

     An employee may take full or partial parental leave until the child reaches the age of three.  

     3. For the duration of unpaid leave to care for a child until the child reaches the age of three, the employee retains his place of work (position).

     4. If the employee goes to work before the expiration of leave without pay to care for a child before the age of three, the employee must notify the employer of his intention one month before the start of work.
