Article 187. The basis for the state registration of the birth of a child of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan

     1. The basis for state registration of a child's birth is a medical birth certificate or a copy of a court decision establishing the fact of birth.

     In the case of childbirth outside a medical organization, the medical birth certificate is issued in accordance with the documents certifying the identity of the mother by the responsible medical officer of the maternity organization, where she applied within five days after giving birth.

     In the absence of documents certifying the identity of the parents, at the time of the state registration of the child's birth, information about the child's parents is filled in according to the information provided by the digital system of civil status certificates.  

     In cases of the birth of a child in a medical organization and the absence of documents certifying the identity of the mother, at the time of state registration of the birth, the surname, first name, patronymic (if any) of the mother are filled in according to the medical birth certificate, which contains a note that the information about the mother is recorded from her words.

     In the future, information about the child's mother in the record of the birth certificate is supplemented in accordance with the procedure established by the marriage and family legislation of the Republic of Kazakhstan.

The basis for registration of the birth of a child born outside a medical organization and without the presence of identity documents for the mother, including in the State database on individuals, is a medical birth certificate issued by the organization of maternity care, where she applied within five days after giving birth, with a note that information about the mother is recorded according to her.

     In the absence of a medical birth certificate, the State registration of a child's birth is carried out on the basis of a copy of a court decision establishing the fact of birth.

     The name, patronymic (if any), surname, and nationality of the parents are recorded in the acts of civil status in accordance with Articles 50, 51, and 63 of this Code.  

If the parents have not been identified, the registration of the child's birth is carried out in accordance with Article 196 of this Code.

     In the case of the birth of a child by a surrogate mother, the medical birth certificate is the basis for the state registration of the child's birth.

     2. The child's medical birth certificate must contain all the necessary information about the child's mother, including the last name, first name, patronymic (if any), as well as the date of birth, gender and individual identification number of the child, the date of issue of the document. The medical birth certificate of a child issued in the territory of the Republic of Kazakhstan on paper must be certified by the signature of an official and the seal of a medical organization, and in electronic form must be certified by an electronic digital signature of an official of a medical organization.

     Information about the birth of a child in a medical organization is transferred to the digital system of civil status certificates within one working day from the moment of delivery.

     3. The state registration of the birth of a child with minor parents, as well as a child born to a surrogate mother, is carried out in accordance with the general procedure.

     4. Excluded by the Law of the Republic of Kazakhstan dated 07/14/2022 No. 141-VII (effective ten calendar days after the date of its first official publication).
