Article 158. The basis and procedure for sending persons with tuberculosis for compulsory treatment Code on the Health of the People and the Healthcare System of the Republic of Kazakhstan
1. Compulsory treatment of persons with tuberculosis includes anti-tuberculosis and symptomatic treatment with isolation of patients in phthisiopulmonological organizations and is carried out within the guaranteed scope of free medical care.
2. The grounds for compulsory treatment of persons with tuberculosis are:
1) refusal to treat a patient with a contagious form of tuberculosis, recorded in the patient's medical documentation;
2) unauthorized care and violation of the treatment regimen in the form of gratuitous omission of taking seven daily doses of anti-tuberculosis drugs during the calendar month recorded in the patient's medical documentation.
3. Persons with tuberculosis who have been subjected to compulsory treatment, after discharge from phthisiopulmonological organizations, are required to register with a medical organization at their place of residence.
The rules for providing medical care to persons with tuberculosis who are sent for compulsory treatment are approved by the authorized body.
4. The decision on compulsory treatment of persons suffering from tuberculosis and evading treatment is made by the court at the request of healthcare organizations in accordance with the legislation of the Republic of Kazakhstan.
5. Persons with tuberculosis undergoing compulsory treatment enjoy all the rights of citizens of the Republic of Kazakhstan with restrictions related to the need to comply with the regime of stay in phthisiopulmonological organizations.
6. A person with tuberculosis who has been sent for compulsory treatment retains his place of work.
The time spent on compulsory medical treatment does not interrupt the length of service and is counted in the total length of service.
7. Referral for compulsory treatment to a phthisiopulmonological organization does not entail a criminal record.
8. For a person with tuberculosis who has been sent for compulsory treatment and lives in a dwelling from the state housing stock, housing is maintained throughout the duration of treatment.
