Article 172. Registration of a person with a mental, behavioral disorder (disease) related to the use of psychoactive substances for compulsory treatment Code on the Health of the People and the Healthcare System of the Republic of Kazakhstan
1. A person who is being processed for compulsory treatment in connection with a mental or behavioral disorder (disease) related to the use of psychoactive substances shall be notified of the date and place of the medical examination by the organization providing medical assistance in the field of mental health.
The notification is sent by registered mail, telegram with delivery notification.
2. A person who has been duly notified by an organization providing medical care in the field of mental health about the date and place of a medical examination (except for valid reasons) and who evades a medical examination based on a reasoned conclusion from an organization providing medical care in the field of mental health, shall be brought by the internal affairs bodies for compulsory examination.
3. The drive is carried out by forcibly escorting a person evading a medical examination to the place of compulsory examination for a period of no more than three hours only on working days from nine to eighteen hours.
4. Valid reasons for a person's failure to attend a medical examination are: illness that makes it impossible for him to appear, death of close relatives, natural disasters, and other reasons that make it impossible for him to appear at the appointed time. The person being transferred is obliged to notify the initiator of the compulsory drive if there are valid reasons preventing him from appearing on the call at the appointed time.
5. The conclusion of the drive is announced to the person being driven before its execution, which is confirmed by his signature on the conclusion.
If the person being transferred refuses to sign, a note about this is made in the conclusion.
