On approval of the Standard Rules for the activities of classrooms for child victims of violence

 In accordance with subparagraph 5) of Article 20 of the Law of the Republic of Kazakhstan "On the Prevention of Offenses", I ORDER:

     1. To approve the attached Standard Operating Rules for Child victims of Violence.

     2. The Committee for the Protection of Children's Rights of the Ministry of Education of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:

     1) the state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

     2) posting of this order on the Internet resource of the Ministry of Education of the Republic of Kazakhstan after its official publication;

     3) within ten working days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, submit to the Legal Department of the Ministry of Education of the Republic of Kazakhstan information on the implementation of measures provided for in subparagraphs 1) and 2) of this paragraph.

     3. Control over the execution of this order is entrusted to the supervising Vice Minister of Education of the Republic of Kazakhstan.

     4. This order shall enter into force upon the expiration of ten calendar days after the date of its first official publication.

Standard operating rules for child victims of violence support offices

Chapter 1. General provisions

     1. These standard rules for the activities of classrooms for children who are victims of violence (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 5) of Article 20 of the Law of the Republic of Kazakhstan "On the Prevention of Offenses" and define the procedure for organizing and carrying out the activities of classrooms for children who are victims of violence.

     2. The following concepts are used in these Rules:

     1) A trauma-oriented approach is an approach to organizing work with child victims of violence based on consideration of their possible traumatic experiences and aimed at ensuring safety, support and prevention of re–traumatization.;

     2) offices of assistance to child victims of violence – offices designed to provide comprehensive assistance to children who are victims of violence;

     3) the regional authorized body for the protection of children's rights of the Republic of Kazakhstan is a local executive body that coordinates activities to protect the fundamental rights and legitimate interests of children, prevent and early detect violations of their rights, take measures to restore and protect them, and perform state functions of guardianship or guardianship of minors.

     3. Coordination of the activities of the offices of assistance to child victims of violence (hereinafter referred to as the offices) is carried out by local executive bodies.

Chapter 2. Goals, objectives and principles of the offices of assistance to child victims of violence

     4. The purpose of the classrooms is to provide comprehensive assistance to children who have suffered violence, including during forensic medical examination and investigative actions.

     5. Cabinet tasks:

     1) ensuring the protection of the rights and legitimate interests of minors;

     2) organization of comprehensive assistance and support for children who have suffered violence;

     3) accompanying children who have suffered violence during forensic medical examination and investigative actions, taking into account the principle of ensuring the best interests of the child;

     4) ensuring cooperation with authorized state bodies, including law enforcement agencies, bodies performing guardianship or guardianship functions, and medical organizations, in order to provide timely assistance to children who have suffered violence.

     6. The activities of the classrooms are based on the principles of legality, confidentiality and the priority of the best interests of the child.

Chapter 3. The procedure for the operation of classrooms for child victims of violence

     7. The activities of cabinets are organized in cities, districts (cities of regional significance), districts in the city, cities of regional significance, towns, villages, rural districts on the basis of organizations or in the form of independent legal entities determined by local executive bodies, including through a state social order.

     8. Decisions on the establishment, reorganization and liquidation of cabinets, as well as on the appointment and dismissal of the head of the cabinet, are taken by local executive bodies.

     9. The offices carry out their activities in the following areas::

     1) psychological – assistance to psychological support centers in providing individual psychological assistance to children who have suffered violence, including diagnostics and consultations aimed at solving psychoemotional problems, crisis situations, and overcoming the consequences of traumatic events;

     2) medical – assistance in obtaining a guaranteed amount of free medical care, hospitalization in a healthcare organization;

     3) forensic medical – cooperation with forensic medical experts to conduct a comprehensive forensic medical assessment of the condition of children who have suffered violence;

     4) investigative – support and support for children who have suffered violence during investigative actions by internal affairs bodies.

     10. Assistance to children who have suffered violence is provided in classrooms around the clock and free of charge.

     11. Assistance to children who have suffered violence is provided with the written or informed consent of the parents or other legal representatives, except in cases where the body responsible for guardianship or guardianship has established that there are contradictions between the interests of the parents or other legal representatives and the child.

     In case of disagreement between parents and other legal representatives and the child, the body performing the functions of guardianship or guardianship is obliged to appoint a representative to protect the rights and interests of the child in accordance with the Code of the Republic of Kazakhstan "On Marriage (Matrimony) and Family".

     12. Children who have been victims of violence are admitted to the classrooms from birth to the age of eighteen.

     13. The grounds for accepting children who have suffered violence are the statement of the person who delivered the minor, or the independent appeal of the minor.

     14. Data on minors who have been delivered or who have applied to the offices on their own is recorded in the register of children who have suffered violence in accordance with Appendix 1 to these Rules.

     15. When admitting a minor, an employee of the office draws up an act of admission of a child who has suffered violence to the office in accordance with Appendix 2 to these Rules.

     16. The head of the office at the reception of a child victim of violence:

     1) immediately inform the parents or other legal representatives of the child about this, except in cases where this is contrary to the interests of the child;

     2) in case of emergency medical assistance to a minor, immediately call an ambulance.;

     3) immediately summons representatives of the internal affairs bodies, the psychological support center, the bodies performing guardianship or guardianship functions, and the healthcare organization.

     17. During their stay in the office, every child who has suffered violence is guaranteed:

     1) protection of his life and health;

     2) protection of his dignity;

     3) Protection from all forms of violence;

     4) receiving qualified assistance.

     18. A specialist of the psychological support center immediately conducts an initial assessment of the situation of a child victim of violence in accordance with Annex 3 to these Rules.

     19. The internal affairs bodies carry out the necessary measures in accordance with the criminal procedure legislation of the Republic of Kazakhstan.

     20. The child's testimony is accepted in compliance with procedural rules and minimizing the need for repeated interrogation.

     21. If a decision is made to appoint a forensic medical examination for a child who has suffered violence, it is carried out in an equipped section of the office with the involvement of a forensic medical expert.

     22. The forensic medical examination is conducted in conditions that ensure privacy, respect for the dignity of the child and a minimum number of persons present who are not directly involved in conducting the forensic medical examination.

     23. When conducting a forensic medical examination and investigative actions against a child who has suffered violence, if possible, the participation of a specialist of the same sex as the child or another specialist is ensured, taking into account the psychological state of the child.

     24. The specialist of the psychological support center has the right to recommend the conditions, form and sequence of investigative and forensic actions in order to minimize repeated injury to the child.

     25. The body performing the functions of guardianship or guardianship ensures the transfer of a child victim of violence brought to the office to the parents or other legal representatives of the child, and if this contradicts the interests of the child and (or) directly threatens his life or health, decides on the further placement of the child victim of violence in in accordance with the Code of the Republic of Kazakhstan "On Marriage (Matrimony) and Family".

26. Based on the initial assessment of the situation of a child who has suffered violence, the head of the cabinet draws up and signs an individual work plan (hereinafter referred to as the IPR) in accordance with Annex 4 to these Rules in coordination with the internal affairs bodies, a forensic medical expert, a psychological support center, a body performing guardianship or guardianship functions and parents. or other legal representatives of the child.

     27. The measures reflected in the IPR are carried out by representatives of the internal affairs bodies, the psychological support center, the body performing the functions of guardianship or guardianship, and a forensic medical expert.

     28. Children who have suffered violence temporarily stay in the office for the period of primary care and procedures provided for in these Rules, with the possibility of leaving and returning if necessary.

     29. Assistance to children who have suffered violence is carried out taking into account the age, gender, individual developmental characteristics, and psychological state of the child using a trauma-oriented approach that takes into account the rights and needs of the child.

     30. Personal data of minors that became known during the stay of children who suffered violence in the office are not disclosed in accordance with the Law of the Republic of Kazakhstan "On Personal Data and their Protection".

     31. It is prohibited to publish materials containing personal data of the child and his family (identification data, photographs, addresses, names of educational organizations).

     32. Control over the assistance provided to children who have suffered violence is carried out by the regional authorized body for the protection of children's rights of the Republic of Kazakhstan in accordance with the Law of the Republic of Kazakhstan "On the Rights of the Child in the Republic of Kazakhstan".

     33. The cabinet consists of the following sections, which are located in an isolated space for unauthorized access:

     1) a section for conducting a forensic medical examination;

     2) section for conducting investigative actions;

     3) psychologist's section;

     4) the working section.

     34. The sections contain information about the work of the cabinet and the services provided.

     When organizing the object-spatial environment of children, oversaturation of unnecessary details, excessive use of decorative elements and bright contrasting colors are excluded.

     35. Bright and neutral colors are used to decorate the office and furniture, ensuring a calm emotional state of the children.

     36. At the entrance to the office, there is a waiting group for children who have suffered violence, where conditions are created for the safety and comfort of children.

     37. The cabinet is equipped with equipment in accordance with Appendix 5 to these Rules.

     38. The cabinets are funded from local budgets.
