Article 1078. The preferential right of individual heirs to the property included in the inheritance of the Civil Code of the Republic of Kazakhstan
1. Heirs who lived together with the testator during the year prior to the opening of the inheritance have a preferential right to inherit the dwelling, as well as household utensils and household items.
2. Heirs who, together with the testator, possessed the right of common ownership of property, have the pre-emptive right to inherit property that was in common ownership.
3. When exercising the pre-emptive rights specified in paragraphs 1 and 2 of this article, the property interests of other heirs participating in the division must be respected. If the property forming the inheritance is not sufficient to provide the shares due to them, the heir exercising the pre-emptive right must provide them with appropriate monetary or property compensation.
