Article 16. Use of narcotic drugs, psychotropic Substances and Precursors for medical purposes of the Law on Narcotic Drugs, Psychotropic Substances, Their Analogues and Precursors and Measures to Counteract their Illicit Trafficking and Abuse
1. Narcotic drugs, psychotropic substances and precursors subject to control in the Republic of Kazakhstan may be used for medical purposes in accordance with the procedure established by the authorized body in the field of healthcare in coordination with the authorized state body in the field of trafficking in narcotic drugs, psychotropic substances, their analogues and precursors.
2. Medicines approved for medical use included in the List of Narcotic Drugs, Psychotropic Substances and Precursors subject to Control in the Republic of Kazakhstan are subject to the provisions applicable to all medicines established by the legislation of the Republic of Kazakhstan, if these provisions do not contradict this Law.
3. The medical use of narcotic drugs, psychotropic substances and precursors included in the List of Narcotic Drugs, Psychotropic Substances and Precursors subject to Control in the Republic of Kazakhstan is carried out in accordance with the regulatory legal acts of the Republic of Kazakhstan.
4. Control over the turnover of narcotic drugs, psychotropic substances and precursors in healthcare organizations and pharmacy organizations is carried out by the authorized body in the field of healthcare.
5. The right to use medicines containing narcotic drugs, psychotropic substances and precursors included in the List of Narcotic Drugs, Psychotropic Substances and Precursors subject to control in the Republic of Kazakhstan applies to civilian sanitary transport. Illegal exercise of this right on other types of civil transport entails liability in accordance with the procedure established by the laws of the Republic of Kazakhstan.
6. Medicinal products containing narcotic drugs, psychotropic substances and precursors used only for the provision of primary health care in emergency cases included in the List of Narcotic Drugs, psychotropic Substances and precursors subject to control in the Republic of Kazakhstan may be:
1) in outpatient, inpatient, inpatient-substituting conditions, hospitals at home, when calling a mobile team, an ambulance team, during transportation by medical aircraft, as well as in medical trains, mobile (field) medical complexes, field hospitals, highway medical and rescue points;
2) in combat vehicles (ships) when going to tactical exercises (in the area of navigation) and field (naval) exercises;
3) on aircraft when flying in the pilot's first aid kit;
4) in the cabinets (stacks) of emergency care of state institutions, the Armed Forces of the Republic of Kazakhstan, other troops and military formations.
Permission for their use and the accounting procedure are established by the authorized state body in the field of trafficking in narcotic drugs, psychotropic substances, their analogues and precursors in coordination with the authorized body in the field of healthcare in accordance with the legislation of the Republic of Kazakhstan.
7. The permit referred to in paragraph 6 of this article sets out the measures that must be taken to prevent the improper use of these medicines and their diversion through illegal channels. It indicates the persons from among the crew who will be entrusted with these medicines, the conditions of their storage, registration of their release, replacement, as well as the frequency of reports on their use.
8. The use of medicinal products in accordance with paragraph 7 of this Article in emergency cases and in emergency situations shall not be considered as a violation of the provisions of this Law on the procedure for the release of narcotic drugs, psychotropic substances and precursors to citizens.

This Law regulates the legal basis of state policy in the sphere of trafficking in narcotic drugs, psychotropic substances, their analogues and precursors and establishes measures to counteract their illicit trafficking in order to provide drug treatment and protect the health of citizens, public and state security.
