Article 28. Controlled delivery of the Law on Narcotic Drugs, Psychotropic Substances, Their Analogues and Precursors and Measures to Counteract their Illicit Trafficking and Abuse

Article 28. Controlled delivery of the Law on Narcotic Drugs, Psychotropic Substances, Their Analogues and Precursors and Measures to Counteract their Illicit Trafficking and Abuse  

     1. Authorized bodies of the Republic of Kazakhstan authorized to carry out operational-investigative, counterintelligence activities in order to identify sources and channels of illicit trafficking in narcotic drugs, psychotropic substances, their analogues and precursors, as well as persons involved in this, in each individual case, by agreement with the relevant authorities of foreign states or on the basis of international treaties may use the method of controlled delivery, that is, to allow importation into the territory of the state or export abroad under the control of these authorities, transit of narcotic drugs, psychotropic substances, their analogues and precursors.

     2. Controlled delivery may also be used in relation to the illegal transportation and transfer of narcotic drugs, psychotropic substances, their analogues and precursors, which are carried out within the territory of the State.  

      3. The procedure for controlled delivery is determined by the legislation of the Republic of Kazakhstan and international treaties.  

 

 

The Law of the Republic of Kazakhstan dated July 10, 1998 No. 279.

     This Law regulates the legal basis of state policy in the sphere of trafficking in narcotic drugs, psychotropic substances, their analogues and precursors and establishes measures to counteract their illicit trafficking in order to provide drug treatment and protect the health of citizens, public and state security.
