Article 35. Principles of providing medical and sanitary care to persons with mental and behavioral disorders (diseases) related to the use of psychoactive Substances of the Law on Narcotic Drugs, Psychotropic Substances, Their Analogues and Precursors and Measures to Counteract their Illicit Trafficking and Abuse
1. Medical and sanitary care for persons with mental and behavioral disorders (diseases) related to the use of psychoactive substances includes the prevention of mental and behavioral disorders (diseases) related to the use of psychoactive substances, examination of persons, diagnosis of disorders, treatment, care, medical and social rehabilitation of persons suffering from mental, behavioral disorders (diseases) related to the use of psychoactive substances, and is carried out in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
2. Medical and sanitary care for persons with mental and behavioral disorders (diseases) related to the use of psychoactive substances is guaranteed by the State and is carried out on the basis of the principles of legality, humanity and respect for human and civil rights.
3. Medical and sanitary assistance to persons with mental and behavioral disorders (diseases) related to the use of psychoactive substances is provided upon a person's voluntary request for medical help from an organization providing medical assistance in the field of mental health. A minor, as well as a person declared legally incompetent by a court, is provided with the consent of their legal representatives in accordance with the procedure provided for by the legislation of the Republic of Kazakhstan.
4. Persons with mental and behavioral disorders (diseases) related to the use of psychoactive substances who evade voluntary treatment are subject to compulsory treatment in organizations providing medical care in the field of mental health, in accordance with the procedure provided for by the legislation of the Republic of Kazakhstan.
5. Persons with mental and behavioral disorders (diseases) related to the use of psychoactive substances who have committed criminal offenses, medical and sanitary assistance is provided on the basis and in accordance with the procedure provided for by the legislation of the Republic of Kazakhstan.
6. For the period of voluntary inpatient treatment, a person with mental and behavioral disorders (diseases) related to the use of psychoactive substances is issued a temporary disability certificate, and upon completion of treatment, at his request, a certificate indicating the purpose of treatment.
7. A person who voluntarily applies to an organization providing medical assistance in the field of mental health for treatment is provided, upon request, with anonymity of treatment. Information about such treatment can only be provided to the internal affairs bodies and other State bodies in the case of bringing this person to criminal or administrative responsibility.

This Law regulates the legal basis of state policy in the sphere of trafficking in narcotic drugs, psychotropic substances, their analogues and precursors and establishes measures to counteract their illicit trafficking in order to provide drug treatment and protect the health of citizens, public and state security.
