Article 22. Cultivation and collection of plants containing narcotic drugs, psychotropic Substances and Precursors of the Law on Narcotic Drugs, Psychotropic Substances, Their Analogues and Precursors and Measures to Counteract their Illicit Trafficking and Abuse
1. The cultivation and harvesting of plants containing narcotic drugs, psychotropic substances and precursors, and their use for industrial, medical, educational and scientific purposes, are permitted to legal entities licensed for this type of activity in an amount not exceeding the state quota established by the Government of the Republic of Kazakhstan.
2. Cultivation and harvesting of opium poppy, coca bush and cannabis (cannabis) for the purpose of manufacturing narcotic medicines in the territory of the Republic of Kazakhstan is prohibited, except in cases provided for in Article 18 of this Law.
3. The decision to ban the cultivation and harvesting of other plants containing narcotic drugs, psychotropic substances and precursors in the territory of the Republic of Kazakhstan is taken by the Government of the Republic of Kazakhstan.
4. Excluded by the Law of the Republic of Kazakhstan dated 04/19/2023 No. 223-VII (effective ten calendar days after the date of its first official publication).
5. The varieties of the cannabis plant allowed for cultivation for industrial purposes not related to the production or manufacture of narcotic drugs and psychotropic substances are determined by the Government of the Republic of Kazakhstan on the proposal of the authorized body in the field of development of the agro-industrial complex, agreed with the authorized state body in the field of trafficking in narcotic drugs, psychotropic substances, their analogues and precursors., authorized bodies in the field of healthcare and state stimulation of industry.
6. The requirements for the conditions of cultivation and the determination of the permissible content of tetrahydrocannabinol in a cannabis plant allowed for cultivation for industrial purposes not related to the production or manufacture of narcotic drugs and psychotropic substances are established by the Government of the Republic of Kazakhstan on the proposal of the authorized body in the field of development of the agro-industrial complex, agreed with the authorized state body in the field of drug trafficking, psychotropic substances, their analogues and precursors, authorized bodies in the field of healthcare and state stimulation of industry.
7. The procedure for industrial processing of cannabis plant varieties permitted for cultivation for industrial purposes not related to the production or manufacture of narcotic drugs and psychotropic substances is determined by the Government of the Republic of Kazakhstan on the proposal of the authorized body in the field of state stimulation of industry, agreed with the authorized bodies in the field of development of the agro-industrial complex and healthcare.
The Law of the Republic of Kazakhstan dated July 10, 1998 No. 279.
This Law regulates the legal basis of state policy in the sphere of trafficking in narcotic drugs, psychotropic substances, their analogues and precursors and establishes measures to counteract their illicit trafficking in order to provide drug treatment and protect the health of citizens, public and state security.
