Article 21. Destruction of Narcotic Drugs, Psychotropic Substances, their Analogues and Precursors of the Law On Narcotic Drugs, Psychotropic Substances, Their Analogues and Precursors and Measures to Counteract their Illicit Trafficking and Abuse
1. Narcotic drugs, psychotropic substances, their analogues, precursors and herbal preparations containing narcotic drugs, as well as tools and equipment, the further use of which in circulation is considered inappropriate, are subject to destruction in accordance with the procedure established by regulatory legal acts of the Republic of Kazakhstan.
2. The destruction of narcotic drugs, psychotropic substances, their analogues and precursors may be carried out in cases where:
1) the expiration date of narcotic drugs, psychotropic substances and precursors has expired;
2) narcotic drugs, psychotropic substances, and precursors have been subjected to chemical or physical effects, resulting in their unusability, precluding the possibility of their recovery or processing;
3) narcotic drugs, psychotropic substances, their analogues and precursors, which have been confiscated, discovered and withdrawn from illicit trafficking, do not represent medical, scientific or other value and cannot be processed, as well as in other cases provided for by the legislation of the Republic of Kazakhstan.
3. Any legal entities that do not have licenses to cultivate and collect plants containing narcotic drugs and psychotropic substances, citizens who own or use land plots on which these plants grow, are obliged to destroy them.
4. Violation of the requirements of paragraph 3 of this Article entails liability provided for by the laws of the Republic of Kazakhstan.
The Law of the Republic of Kazakhstan dated July 10, 1998 No. 279.
This Law regulates the legal basis of state policy in the sphere of trafficking in narcotic drugs, psychotropic substances, their analogues and precursors and establishes measures to counteract their illicit trafficking in order to provide drug treatment and protect the health of citizens, public and state security.
