Article 5. State regulation of the turnover of narcotic drugs, psychotropic substances, their analogues, precursors and measures to counteract their illicit trafficking and abuse of the Law On Narcotic Drugs, Psychotropic Substances, Their Analogues and Precursors and Measures to Counteract their Illicit Trafficking and Abuse

Article 5. State regulation of the turnover of narcotic drugs, psychotropic substances, their analogues, precursors and measures to counteract their illicit trafficking and abuse of the Law On Narcotic Drugs, Psychotropic Substances, Their Analogues and Precursors and Measures to Counteract their Illicit Trafficking and Abuse  

  1. State regulation of the turnover of narcotic drugs, psychotropic substances, precursors and measures to counteract their illicit trafficking and abuse are carried out in accordance with this Law, other laws of the Republic of Kazakhstan, decrees of the President of the Republic of Kazakhstan and resolutions of the Government of the Republic of Kazakhstan.

     The Government of the Republic of Kazakhstan approves the regulatory legal acts developed by the authorized state body in the field of trafficking in narcotic drugs, psychotropic substances, their analogues and precursors, in coordination with the relevant state bodies, regulating the activities of legal entities involved in trafficking in narcotic drugs, psychotropic substances, precursors and countering their illicit trafficking and abuse.

     1-1. The Government of the Republic of Kazakhstan approves the List of narcotic drugs, psychotropic substances and precursors subject to control in the Republic of Kazakhstan developed by the authorized state body in the field of trafficking in narcotic drugs, psychotropic substances, their analogues and precursors, in coordination with the authorized bodies, a summary table on the classification of narcotic drugs, psychotropic substances, their analogues and precursors found in illicit trafficking, to small, large and especially large sizes and a list of substituents of hydrogen atoms, halogens and (or) hydroxyl groups in the structural formulas of narcotic drugs, psychotropic substances, and also determines the order of their formation.

     3. The authorized state body in the sphere of trafficking in narcotic drugs, psychotropic substances, their analogues and precursors performs the following main functions:

     1) excluded by the Law of the Republic of Kazakhstan dated 07/03/2013 No. 124-V (effective after ten calendar days after its first official publication); 2) excluded by the Law of the Republic of Kazakhstan dated 07/05/2011 No. 452-IV (effective from 10/13/2011);

     3) organizes the implementation of state control over the turnover of narcotic drugs, psychotropic substances and precursors and measures to counteract their illicit trafficking and abuse;

     4) assist health authorities in regulating activities in the field of trafficking in narcotic drugs, psychotropic substances, precursors and their abuse in organizing medical and social assistance to persons with mental behavioral disorders (diseases) related to the use of psychoactive substances and ensuring the guarantee of citizens' rights and freedoms in its provision;

     5) develop a List of narcotic drugs, psychotropic substances and precursors subject to control in the Republic of Kazakhstan, a summary table on the classification of narcotic drugs, psychotropic substances, their analogues and precursors found in illicit trafficking to small, large and especially large sizes and a List of substituents of hydrogen atoms, halogens and (or) hydroxyl groups in structural formulas of narcotic drugs and psychotropic substances;

     6) excluded by the Law of the Republic of Kazakhstan dated 30.06.2025 No. 203-VIII (effective ten calendar days after the date of its first official publication);

     7) determines, together with the authorized bodies, the norms of the state's demand for narcotic drugs, psychotropic substances and precursors;

     8) controls the process of developing and introducing narcotic drugs, psychotropic substances and precursors that have less narcotic effects, are more effective, and are less dangerous than existing ones;

     9) submits to the Government the norms of the Republic's demand for narcotic drugs, psychotropic substances and precursors for approval of international quotas for the Republic of Kazakhstan by the UN International Narcotics Control Board;

     10) excluded by the Law of the Republic of Kazakhstan dated January 13, 2014 No. 159-V (effective after ten calendar days after the date of its first official publication); 11) excluded by the Law of the Republic of Kazakhstan dated January 13, 2014 No. 159-V (effective after ten calendar days after the date of its first official publication);

     12) coordinates the work of public organizations and associations whose activities are related to the prevention of non-medical use of narcotic drugs, psychotropic substances, and their analogues;

     13) carries out international cooperation in the field of trafficking in narcotic drugs, psychotropic substances, precursors and countering their illicit trafficking and abuse;

     14) carries out licensing of activities in the sphere of trafficking in narcotic drugs, psychotropic substances and precursors, except for activities related to trafficking in narcotic drugs, psychotropic substances and precursors, in the field of healthcare;

     15) excluded by the Law of the Republic of Kazakhstan dated 03/02/2006 No. 130 (effective from the date of its official publication);

     16) submits proposals to the relevant authorities on bringing individuals and legal entities to responsibility for violations of legislative and other regulatory legal acts of the Republic of Kazakhstan regulating the turnover of narcotic drugs, psychotropic substances and precursors;

     17) excluded by the Law of the Republic of Kazakhstan dated January 13, 2014 No. 159-V (effective ten calendar days after the date of its first official publication);

     18) submits submissions and prescriptions to state bodies and other organizations to eliminate violations of the legislation of the Republic of Kazakhstan in the sphere of trafficking in narcotic drugs, psychotropic substances and precursors;

     19) excluded by the Law of the Republic of Kazakhstan dated 30.06.2025 No. 203-VIII (effective ten calendar days after the date of its first official publication);

     20) coordinates the fight against illicit trafficking in narcotic drugs, psychotropic substances, their analogues, precursors and their abuse, including through the use of remote sensing data.;

     21) carries out state control over the activities of state bodies and other organizations in the sphere of trafficking in narcotic drugs, psychotropic substances, and precursors;

     22) excluded by the Law of the Republic of Kazakhstan dated 30.06.2025 No. 203-VIII (effective ten calendar days after the date of its first official publication);

     23) carries out, within its competence, the attraction of investments, technical assistance and control over their targeted use in the sphere of trafficking in narcotic drugs, psychotropic substances, precursors and countering their illicit trafficking and abuse in accordance with the legislation of the Republic of Kazakhstan;

     23-1) develops and approves regulatory legal acts in the field of trafficking in narcotic drugs, psychotropic substances, their analogues and precursors in accordance with the goals and objectives of this Law and the legislation of the Republic of Kazakhstan;

     24) other powers provided for by this Law, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

 

The Law of the Republic of Kazakhstan dated July 10, 1998 No. 279.

     This Law regulates the legal basis of state policy in the sphere of trafficking in narcotic drugs, psychotropic substances, their analogues and precursors and establishes measures to counteract their illicit trafficking in order to provide drug treatment and protect the health of citizens, public and state security.
