Article 2. Classification of narcotic drugs, psychotropic substances, their analogues and precursors subject to control in the Republic of Kazakhstan of the Law On Narcotic Drugs, Psychotropic Substances, Their Analogues and Precursors and Measures to counteract their Illicit Trafficking and Abuse
1. Narcotic drugs, psychotropic substances and precursors are included in the List of Narcotic drugs, psychotropic Substances and Precursors subject to control in the Republic of Kazakhstan. The list of narcotic drugs, psychotropic substances and precursors subject to control in the Republic of Kazakhstan consists of four tables and a list. Table I includes narcotic drugs and psychotropic substances, the turnover of which is prohibited in the Republic of Kazakhstan in accordance with the legislation of the Republic of Kazakhstan and the international conventions of the United Nations of 1961 and 1971, with the exception of cases provided for in Articles 18, 19 and 20 of this Law.
Table II includes narcotic drugs and psychotropic substances, the turnover of which is limited and under strict control in accordance with the legislation of the Republic of Kazakhstan and the international conventions of the United Nations of 1961 and 1971.
Table III includes narcotic drugs and psychotropic substances, the turnover of which is under control in accordance with the legislation of the Republic of Kazakhstan and the UN international Conventions of 1961 and 1971.
Table IV includes precursors, the turnover of which is under control in accordance with the legislation of the Republic of Kazakhstan and the UN International Convention of 1988.
The list of medicines containing narcotic drugs, psychotropic substances and precursors subject to control in the Republic of Kazakhstan and approved for use in veterinary medicine includes medicines that can be used as diagnostic, therapeutic and preventive agents if licensed accordingly.
1-1. The inclusion of a substance in the List of Narcotic Drugs, Psychotropic Substances and Precursors subject to control in the Republic of Kazakhstan is carried out on one of the following grounds:
when receiving recommendations from the UN International Narcotics Control Board;
if there is a substance in the lists, lists, tables of narcotic drugs, psychotropic substances and precursors subject to control in the countries of the Eurasian Economic Union.
1-2. Substances are classified as analogues of narcotic drugs and psychotropic substances by conducting a forensic examination in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
The subjects of forensic examination are the correlation of the structural formula of a substance with the structural formulas of narcotic drugs, psychotropic substances and precursors subject to control in the Republic of Kazakhstan, and the determination of the presence in this structural formula of one or more substituents of hydrogen atoms, halogens and (or) hydroxyl groups.
1-3. If a psychoactive substance is found in circulation that is not under the control of the International Narcotics Control Board of the United Nations and the countries of the Eurasian Economic Union, it is classified as narcotic drugs, psychotropic substances and precursors in accordance with the Single Convention on Narcotic Drugs of 1961, as amended by the 1972 Protocol on Amendments to the Single Convention on Narcotic Drugs of 1961.
2. In relation to drugs, the types of control are provided, which are established in relation to narcotic drugs, psychotropic substances and precursors contained in them. If a drug contains not one but several narcotic drugs, psychotropic substances and precursors, it is subject to the same control as the narcotic drug, psychotropic substance and precursor, which are subject to the strictest control measures. Medicinal products that contain small amounts of narcotic drugs, psychotropic substances and precursors and pose little danger if they are abused and from which these drugs and substances cannot be extracted by easily accessible methods are not subject to control in accordance with this Law.
The list of these drugs and the procedure for their exclusion from control are approved by the Government of the Republic of Kazakhstan.
3. Analogues of narcotic drugs and psychotropic substances are subject to the same control measures as narcotic drugs and psychotropic substances of similar structure and properties. When determining the size of analogues, the sizes of narcotic drugs and psychotropic substances of which they are analogues are used.
The Law of the Republic of Kazakhstan dated July 10, 1998 No. 279.
This Law regulates the legal basis of state policy in the sphere of trafficking in narcotic drugs, psychotropic substances, their analogues and precursors and establishes measures to counteract their illicit trafficking in order to provide drug treatment and protect the health of citizens, public and state security.
