Article 6. State control over the turnover of narcotic drugs, psychotropic substances, precursors and measures to counteract their illicit trafficking and abuse of the Law On Narcotic Drugs, Psychotropic Substances, Their Analogues and Precursors and Measures to Counteract their Illicit Trafficking and Abuse
1. State control over the turnover of narcotic drugs, psychotropic substances and precursors is carried out by an employee (employees) of the internal affairs bodies of the Republic of Kazakhstan in the form of an inspection with a visit to the subject (object) of control.
The procedure for conducting an inspection with a visit to the subject (object) of control is carried out in accordance with Article 6-1 of this Law.
2. Authorized bodies of the Republic of Kazakhstan have the right to:
1) to carry out state control over the turnover of narcotic drugs, psychotropic substances and precursors;
2) in order to exercise state control in the sphere of trafficking in narcotic drugs, psychotropic substances and precursors, visit any premises, regardless of the form of ownership, used for trafficking in narcotic drugs, psychotropic substances and precursors;
3) to inspect land plots on which plants containing narcotic substances included in the List of narcotic drugs, psychotropic substances and precursors subject to control in the Republic of Kazakhstan are cultivated;
4) to carry out measures for the destruction of plants containing narcotic substances by specially created units;
5) receive from legal entities engaged in activities related to the trafficking of narcotic drugs, psychotropic substances and precursors, technical documentation characterizing the quality of narcotic drugs, psychotropic substances and precursors, as well as samples of these products in technically reasonable quantities for their examination;
6) issue instructions on the elimination of identified violations in the sphere of trafficking in narcotic drugs, psychotropic substances and precursors in accordance with the legislation of the Republic of Kazakhstan;
7) excluded by the Law of the Republic of Kazakhstan dated 04/06/2024 No. 71-VIII (effective sixty calendar days after the date of its first official publication).
8) submit proposals to the relevant authorities on bringing individuals and legal entities to justice for violations of legislative and other regulatory legal acts of the Republic of Kazakhstan regulating the turnover of narcotic drugs, psychotropic substances and precursors.
The Law of the Republic of Kazakhstan dated July 10, 1998 No. 279.
This Law regulates the legal basis of state policy in the sphere of trafficking in narcotic drugs, psychotropic substances, their analogues and precursors and establishes measures to counteract their illicit trafficking in order to provide drug treatment and protect the health of citizens, public and state security.
