Article 17. Measures to preserve the habitat, breeding conditions, migration routes and places of concentration of animals in the design and implementation of economic and other activities of the Law on the Protection, Reproduction and Use of Wildlife
1. During the placement, design and construction of settlements, enterprises, structures and other facilities, the implementation of production processes and the operation of vehicles, the improvement of existing and the introduction of new technological processes, the introduction into economic circulation of unused, coastal, swampy, shrubby territories, land reclamation, the use of forest resources and water bodies, conducting geological exploration works, mining, determining the places of grazing and running of farm animals, The development of tourist routes and the organization of places of mass recreation for the population should provide for and implement measures to preserve the habitat and breeding conditions of wildlife, migration routes and places of concentration of animals, as well as ensure the inviolability of areas of particular value as a habitat for wild animals.
2. During the operation, placement, design and construction of railways, highways, pipelines and other transport routes, power transmission and communication lines, water management and hydraulic structures, measures should be developed and implemented to ensure the preservation of habitat, breeding conditions, migration routes and places of concentration of animals.
3. Entities engaged in economic and other activities specified in paragraphs 1 and 2 of this Article shall be obliged to:
1) in coordination with the authorized body or the authorized body in the field of fisheries, within the limits of its competence, when developing a feasibility study and design estimates, provide funds for the implementation of measures to ensure compliance with the requirements of subparagraphs 2) and 5) of paragraph 2 of Article 12 of this Law.;
2) compensate for damage caused and inflicted to fish resources and other aquatic animals, including unavoidable ones, in the amount determined in accordance with the methodology approved by the authorized body in the field of fisheries, by carrying out measures providing for the release of fish planting material into fisheries reservoirs, restoration of spawning grounds, fisheries reclamation of water bodies, construction infrastructure of the reproductive complex or reconstruction of existing complexes for the reproduction of fish resources and other aquatic animals, financing of scientific research, measures for the protection of rare and endangered fish and other aquatic animals, as well as the creation of artificial spawning grounds in the floodplain of rivers and the marine environment (reefs), on the basis of an agreement concluded with the department of the authorized body in the field of fisheries.
By decision of the department of the authorized body in the field of fisheries, entities engaged in economic and other activities specified in paragraphs 1 and 2 of this article shall compensate for the damage provided for in subparagraph 2) of the first part of this paragraph, by transferring funds to the accounts of state-owned enterprises of the reproductive complex to finance construction, reconstruction (modernization) and its material and technical equipment.
