Article 34. Types of fishing Chapter 6. Fishing The Law on the Protection, Reproduction and Use of Wildlife

   1. Fishing is divided into the following types:

     1) Commercial fishing;

     2) amateur (sport) fishing;

     3) scientific research fishing;

     4) control fishing;

     5) reclamation fishing;

     6) fishing for reproductive purposes.

     7) excluded by the Law of the Republic of Kazakhstan dated 06/15/2017 No. 73-VI (effective ten calendar days after the date of its first official publication).

     2. Commercial fishing is a complex process that ensures the removal of fish resources and other aquatic animals from their habitat with fishing gear that allows simultaneous fishing of a large number of fish resources and other aquatic animals.

     Commercial fishing is carried out for business purposes.

     Commercial fishing can be carried out by coastal and sea fishing.

     Coastal fishing is fishing of fish resources and other aquatic animals carried out in fixed fishery reservoirs and (or) sites.

     Sea fishing is fishing of fish resources and other aquatic animals carried out in the open part of water bodies (seas, lakes) outside the fixed areas, as well as in the fishing area and the general water area.

     Commercial fishing is not allowed in recreational fishing zones established by the local executive body.

     Fishing of joint aquatic biological resources is carried out in territorial waters, fishing zone and common water area.

     3. Amateur (sport) fishing - fishing of fish resources and other aquatic animals in order to meet sporting and aesthetic needs, conduct sports competitions, as well as for personal consumption of caught products, carried out by fishing gear, allowing only piece fishing (non-commercial fishing gear).

     Amateur (sport) fishing can be carried out with the subsequent release of the caught fish into its natural habitat in a live form.

     4. Scientific research fishing – fishing of fish resources and other aquatic animals for the purpose of conducting scientific research in the field of protection, reproduction and use of wildlife.

     Scientific research fishing outside the limits of the withdrawal of fish resources and other aquatic animals is allowed in reservoirs where previously an assessment of the state of wildlife has not been carried out.

     5. Control fishing - fishing of fish resources and other aquatic animals in order to monitor the state of the ichthyofauna, determine the efficiency of reproduction of fish resources and other aquatic animals, yield of juveniles, fish productivity of reservoirs.

     6. Reclamation fishing - fishing of fish resources and other aquatic animals, including total capture, capture of low-value fish species, fishing in flood-prone reservoirs and (or) areas, aimed at increasing the fish productivity of reservoirs, preserving fish resources and other aquatic animals and improving their habitat and breeding conditions.

     Total capture is the removal of the entire commercial stock of fish resources and other aquatic animals in a reservoir or the removal of commercial stocks of individual species or ecological groups of fish. Total trapping can be used as reclamation fishing and for scientific research purposes, as well as to replace ichthyofauna based on scientific recommendations in the management of commercial fish farming.

     7. Fishing for reproductive purposes - fishing of fish resources and other aquatic animals for the purposes of their reproduction.

     8. Excluded by the Law of the Republic of Kazakhstan dated 06/15/2017 No. 73-VI (effective ten calendar days after the date of its first official publication).

     9. The procedure for fishing is determined by the rules of fishing.

 

The Law of the Republic of Kazakhstan dated July 9, 2004 No. 593.

     This Law regulates public relations in the field of protection, reproduction and use of wildlife, as well as the conservation and reproduction of Kazakh dog breeds and is aimed at ensuring conditions for the conservation of wildlife and its biological diversity, sustainable use of wildlife in order to meet environmental, economic, aesthetic and other human needs, taking into account the interests of present and future generations..
