Article 19. Artificial breeding of animal Species of the Law on the Protection, Reproduction and Use of Wildlife

     1. Artificial breeding of animal species is carried out in order to:

     1) conservation and increase in the number of animal species, including valuable, rare and endangered;

     2) scientific research;

     3) introductions, reintroductions and hybridization of animal species;

     4) the use of animal species in business activities.

     2. Artificial breeding of valuable, rare and endangered species of animals in order to preserve and increase their numbers with subsequent release into the habitat is carried out at the expense of budgetary funds and other sources not prohibited by the legislation of the Republic of Kazakhstan.

     2-1. For the purposes of artificial breeding of sturgeon species of fish, state-owned enterprises of the reproductive complex that fulfill state orders may use fish obtained as by-catch for the production of hormonal stimulation drugs for fish spawning, as well as the production of feed for their maintenance.

     2-2. For the purposes of artificial fish farming, it is allowed to use natural and (or) artificial ponds, rice paddies, as well as other artificially created reservoirs.       IZPI's note!      Paragraph 2-2 is provided to be deleted by the Law of the Republic of Kazakhstan dated 06/12/2025 No. 194-VIII (effective sixty calendar days after the date of its first official publication).

     2-3. State-owned enterprises of the reproductive complex that fulfill a state order have the right to conclude contracts with fishing entities for the provision of fishing services for reproductive purposes.

     3. Animals whose species are included in Annex I of the Convention on International Trade in Endangered Species of Wild Fauna and Flora may be traded only if they are bred in captivity and/or semi-captive conditions and registered with an administrative authority.

     3-1. Animals bred in captivity and/or semi-captivity, the species of which are included in annex II of the Convention on International Trade in Endangered Species of Wild Fauna and Flora, may be traded only if they are registered with an administrative authority.

     3-2. When notifying the administrative authority under the Convention on International Trade in Endangered Species of Wild Fauna and Flora of the commencement of artificial breeding activities for animals whose species are included in annexes I and II of the Convention, the following shall be indicated:

     1) the number and date of the administrative authority's import permit – in the case of animal imports;

     2) the number and date of the certificate of origin of the catch, or a purchase and sale agreement is attached indicating the number and date of registration with the administrative authority – in the case of domestic origin of animals.

      4. Artificial breeding of animal species, including in commercial fish farms, cage fish farms, pond fish farms and fish farms with a closed water supply cycle, is carried out for business purposes at the expense of individuals and legal entities and other sources not prohibited by the legislation of the Republic of Kazakhstan.

     5. The Republic of Kazakhstan is establishing a unified system for labeling caviar of sturgeon species for trade in domestic and foreign markets.

     The sale of unmarked caviar of sturgeon species is not allowed.

     6. The live export of individuals of sturgeon species of fish caught from their natural habitat and their fertilized eggs outside the Republic of Kazakhstan is carried out by decision of the Government of the Republic of Kazakhstan.

 

The Law of the Republic of Kazakhstan dated July 9, 2004 No. 593.

     This Law regulates public relations in the field of protection, reproduction and use of wildlife, as well as the conservation and reproduction of Kazakh dog breeds and is aimed at ensuring conditions for the conservation of wildlife and its biological diversity, sustainable use of wildlife in order to meet environmental, economic, aesthetic and other human needs, taking into account the interests of present and future generations..
