Article 297. Illegal acquisition, storage, transportation for the purpose of sale, transfer or sale of narcotic drugs, psychotropic substances, their analogues of the Criminal Code of the Republic of Kazakhstan

1. Illegal acquisition, storage, transportation for the purpose of sale, transfer or sale of narcotic drugs, psychotropic substances, and their analogues –

are punishable by imprisonment for a term of five to eight years with confiscation of property.

2. The same acts committed in relation to narcotic drugs, psychotropic substances, and their analogues on a large scale, –

are punishable by imprisonment for a term of six to ten years with confiscation of property.

3. The acts provided for in the first or second parts of this Article, committed:

1) by a group of persons by prior agreement;

2) repeatedly;

3) in relation to narcotic drugs, psychotropic substances, and their analogues on an especially large scale;

4) excluded by the Law of the Republic of Kazakhstan dated 02.01.2025 No. 150-VIII (effective sixty calendar days after the date of its first official publication). 5) excluded by the Law of the Republic of Kazakhstan dated 02.01.2025 No. 150-VIII (effective sixty calendar days after the date of its first official publication).

6) in a public place, –

are punishable by imprisonment for a term of seven to twelve years with confiscation of property.

4. The acts provided for in parts one, two or three of this article committed by a criminal group or an official using his official position, as well as the sale of narcotic drugs, psychotropic substances, and their analogues in educational organizations or knowingly to a minor –

are punishable by imprisonment for a term of fifteen to twenty years with confiscation of property.
