Article 322. Illegal medical and pharmaceutical activities and illegal issuance or forgery of prescriptions or other documents granting the right to receive narcotic drugs or psychotropic substances of the Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan

1 Engaging in medical or pharmaceutical activities by a person who does not have a certificate and/or license for this type of activity, if this negligently caused moderate harm to human health., –

     is punishable by a fine in the amount of up to two hundred monthly calculation indices or correctional labor in the same amount, or community service for up to two hundred hours, or arrest for up to fifty days, with or without deprivation of the right to hold certain positions and engage in certain activities for up to two years.

2 The same act that negligently caused serious harm to human health, –

     is punishable by a fine in the amount of up to three thousand monthly calculation indices, or correctional labor in the same amount, or community service for up to eight hundred hours, or restriction of liberty for up to three years, or imprisonment for the same term, with deprivation of the right to hold certain positions or engage in certain activities for up to three years. years old or not.

3 The act provided for in the first part of this Article, which negligently caused the death of a person, –

     is punishable by restriction of liberty for a term of up to five years or by imprisonment for the same term, with or without deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years.

4 The act provided for in the first part of this Article, which negligently caused the death of two or more persons, –

     is punishable by restriction of liberty for a term of three to seven years or by imprisonment for the same term, with or without deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years.

5 Illegal issuance or forgery of prescriptions or other documents granting the right to receive narcotic drugs or psychotropic substances, –

     is punishable by a fine in the amount of up to five thousand monthly calculation indices, or correctional labor in the same amount, or community service for up to one thousand two hundred hours, or restriction of liberty for up to five years, or imprisonment for the same term, with deprivation of the right to hold certain positions or engage in certain activities for a period of up to three years or without it.
