Article 85. The rights and obligations of persons wishing to adopt children of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan
1. Citizens of the Republic of Kazakhstan permanently residing in the territory of the Republic of Kazakhstan who wish to adopt children are required to submit to the body performing the functions of guardianship or guardianship at the child's location an application for the desire to adopt a child, as well as provide information on the amount of total income, marital status, health status, lack of criminal record, certificate of undergo psychological training and personally choose a child, have direct contact with him for at least two weeks.
When adopting a child in respect of whom paternity has been established by the applicant's spouse, the conclusion of a molecular genetic examination confirming paternity in respect of the adopted child is attached to the application for the desire to adopt the child.
Citizens of the Republic of Kazakhstan permanently residing in the territory of the Republic of Kazakhstan who wish to adopt orphaned children, children left without parental care, for upbringing in their family have the right to receive psychological training in accordance with this Code free of charge.
2. Citizens of the Republic of Kazakhstan permanently residing in the territory of the Republic of Kazakhstan who wish to adopt orphaned children, children left without parental care, under the age of one year, have the right to take children under guardianship or foster care until the end of the adoption procedure.
3. Citizens of the Republic of Kazakhstan permanently residing outside the Republic of Kazakhstan, foreigners applying for the adoption of a child, submit to the authorized body in the field of protection of children's rights of the Republic of Kazakhstan a written application for the desire to adopt a child, as well as certificates of income, marital status, health status, including the absence of mental, behavioral disorders (diseases), including those related to the use of psychoactive substances, the absence of a criminal record, and the personal moral qualities of potential parents, issued by specially authorized foreign government agencies and adoption organizations. After submitting the documents to the authorized body for the protection of children's rights of the Republic of Kazakhstan and with the consent of the adoptive parent to adopt the child, the adoptive parent must have direct contact with the child for at least four weeks.
