Article 22. Issues resolved by the court when making a decision on the dissolution of marriage (matrimony) of the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan
1. Upon the dissolution of a marriage (matrimony) in court, the spouses may submit to the court an agreement on which of them minor children will live with, on the procedure for paying funds for the maintenance of children and (or) an incapacitated spouse in need, the amount of these funds, or on the division of the spouses' common property, on determining the order of communication of the parent. with a child. The court's decision indicates the names of the spouses after the dissolution of the marriage (matrimony), as well as the terms of the agreement reached.
2. If there is no agreement between the spouses on the issues specified in paragraph 1 of this article, as well as if it is established that this agreement violates the interests of the children or one of the spouses, the court must:
1) determine which parent the minor children will live with after the dissolution of the marriage (matrimony);
2) determine which parent will pay child support and in what amount;
3) at the request of the spouses, divide the property in their common joint ownership, taking into account the interests of minor children and (or) the interests of the spouses themselves.;
4) at the request of a spouse who is entitled to receive maintenance from another spouse, determine the amount of this maintenance.
5) determine the order of communication between the parent and the child.
2-1. When determining the order of communication between a parent and a child, the court takes into account the equality of the rights and duties of parents, as well as the legitimate interests of the child.
3. If the division of property affects the interests of third parties, the court has the right to separate the claim for the division of property into separate proceedings.
