Article 2. Fundamentals of marriage and family legislation of the Republic of Kazakhstan, the Marriage (Matrimony) and Family Code of the Republic of Kazakhstan
1. Marriage and family, motherhood, fatherhood and childhood are protected by the State.
2. The marriage and family legislation of the Republic of Kazakhstan is based on the principles of:
1) the voluntary nature of the marital union of a man and a woman;
2) equality of rights of spouses in the family;
3) the inadmissibility of arbitrary interference by anyone in family affairs;
4) resolving intra-family issues by mutual agreement;
5) the priority of family upbringing of children, taking care of their development and well-being;
6) priority protection of the rights and interests of minors, elderly and disabled family members;
7) ensuring the unhindered exercise by family members of their rights and the possibility of judicial protection of these rights;
8) maintaining a healthy lifestyle for all family members.
9) protection, preservation, strengthening and promotion of traditional family values based on strengthening the institution of marriage and family, fatherhood, motherhood and childhood;
10) ensuring the moral and spiritual upbringing of children in the spirit of respect for universal, national, traditional, cultural and family values in a part that does not contradict the Constitution of the Republic of Kazakhstan and the legislation of the Republic of Kazakhstan.
3. A marriage (matrimony) concluded only by state bodies is recognized.
A marriage entered into according to religious rites and ceremonies is not equivalent to a marriage registered with the registration authorities and does not give rise to corresponding legal consequences.
Marriage (matrimony) is not recognized as the actual cohabitation of both a man and a woman, or persons of the same sex.
4. Any form of restriction of citizens' rights upon marriage (matrimony) and in family relations based on origin, social, official and property status, race, nationality, language, attitude to religion or any other circumstances is prohibited.
The rights of citizens in marital and family relations may be restricted only on the basis of law and only to the extent necessary for the protection of the constitutional order, the protection of public order, human rights and freedoms, public health and morals.
