Article 640. Release by the presiding judge of candidates for jurors from participation in the consideration of the case CPC RK Criminal Procedure Code of the Republic of Kazakhstan
1. The presiding judge explains to the candidates for jurors their duties established by this Code, after which he interviews the candidates for jurors about the existence of circumstances preventing their participation in the consideration of the case as jurors.
2. The chairman, without discussion with the participants in the process, is relieved of his duties as a juror.:
1) suspected or accused of committing a criminal offense;
2) persons who do not speak the language in which the proceedings are conducted, persons with complete loss of speech, persons with complete loss of hearing and persons with complete loss of vision;
3) persons with disabilities in the absence of organizational or technical capabilities to ensure their full participation in the court session.
3. The chairman, without discussion with the participants in the process, may be relieved of the duties of the jurors upon their oral or written application.:
1) persons over sixty-five years of age;
2) women with children under the age of three;
3) persons who, by virtue of their religious beliefs, consider it impossible for them to participate in the administration of justice;
4) persons whose distraction from the performance of official duties may entail significant harm to public and state interests (doctors, teachers, airline pilots, and others);
5) other persons who have valid reasons for not participating in the court session.
4. The presiding judge asks the candidates for the jury to inform them about the circumstances of the case to be considered in court.
5. The presiding judge shall release from the duties of a juror in the case of any candidate for juror whose objectivity raises reasonable doubts due to the unlawful influence exerted on this person, his biased opinion, his knowledge of the circumstances of the case from non-procedural sources, as well as for other reasons indicating the possible bias of the candidate for juror during his participation in the considering the case as a juror.
