Article 36. Exemption from conscription and military training The Law on Military Service and the Status of Military Personnel
1. Citizens are exempt from conscription in peacetime.:
1) deemed unfit for military service for health reasons;
2) those who are not legally called up for military service, upon reaching the age of twenty-seven;
3) in which one of the relatives (father, mother, brother or sister) died, died, or was diagnosed with a disability of the first or second group in the performance of official duties during military service;
4) who have completed military (alternative) service in another country;
4-1) who served in special state bodies of the Republic of Kazakhstan, except for the cases provided for in paragraph 9 of Article 51 of the Law of the Republic of Kazakhstan "On Special State Bodies of the Republic of Kazakhstan";
5) having an academic degree;
6) clergymen of registered religious associations.
2. They are exempt from conscription for military training:
1) persons working in government agencies of the Republic of Kazakhstan in positions related to ensuring defense, security and law and order;
2) aviation personnel of state, civil and experimental aviation;
3) persons working in agriculture and in organizations for the repair of agricultural machinery, for the period of sowing and harvesting;
4) teachers of full-time education organizations for the period of the academic year;
5) full-time students in educational institutions;
6) women who are liable for military service;
7) those liable for military service within two years after their discharge into the reserve;
8) persons with three or more children under the age of eighteen;
9) persons in respect of whom an inquiry is being conducted, a preliminary investigation or a criminal case is being considered by a court;
10) persons liable for military service, elected (appointed) by deputies of the Parliament of the Republic of Kazakhstan or local representative bodies, akims of districts, cities of regional significance, cities of regional significance, villages, towns, rural districts.
3. Those liable for military service specified in subparagraph 7) of paragraph 2 of this article are not exempt from special military training.
4. Citizens who have been declared unfit for military service for health reasons are exempt from conscription on mobilization, under martial law and in wartime.
5. Citizens who have the right to be exempted from conscription may be called up for military service at their request upon the provision of appropriate notarized documents from interested persons and applications, except for citizens specified in subparagraph 1) of paragraph 1 of this Article.
6. Citizens with a criminal record are not subject to conscription in peacetime.
7. Citizens who have lost the grounds for exemption from conscription provided for in subparagraph 1) 1 of this Article, are subject to conscription in accordance with the procedure established by this Law.

This Law regulates public relations in the field of military service by citizens of the Republic of Kazakhstan and defines the foundations of the state policy on social security for military personnel.
