The Ninth Additional Protocol to The Charter of the Universal Postal Union
The plenipotentiary representatives of the Governments of the member countries of the Universal Postal Union, meeting at the Congress in Istanbul, on the basis of Article 30.2 of the Charter of the Universal Postal Union, adopted in Vienna on July 10, 1964, adopted, subject to ratification, the following amendments to the said Charter.
Article I
(Article 1 as amended)
Scope of activity and purpose of the Union
1. The countries that adopt this Charter shall constitute, under the name of the Universal Postal Union, a single postal territory for the mutual exchange of postal items. Freedom of transit is guaranteed throughout the territory of the Union in accordance with the conditions defined in the Acts of the Union.
2. The objectives of the Union are to ensure the organization and improvement of postal communications and to create favorable conditions in this area for the development of international cooperation.
3. The Union shall, to the best of its ability, participate in the provision of technical assistance in the field of postal communications requested by its member States.
Article II
(Article 1bis as amended)
Definitions
1. The following terms used in the Acts of the Union have the meanings defined below:
1.1 Postal Service: all international postal services, the scope of which is determined and regulated by Acts of the Union. The main obligations related to these services are to fulfill certain social and economic tasks of the member countries, which is ensured by the reception, processing, forwarding and delivery of postal items.
1.2 Member country: a country that fulfills the conditions of Article 2 of the Charter.
1.3 Unified Postal Territory (the same postal territory): The obligation imposed on the Contracting Parties in accordance with the Acts of the Union to ensure the mutual exchange of postal items, including freedom of transit, and to process postal items in transit from other countries, without discrimination, in the same manner as their own postal items, in accordance with the conditions defined in the Acts of the Union.
1.4 Freedom of transit: the principle according to which an intermediate member country is obliged to ensure the transportation of mail sent to it to its destination in another member country, processing them in the same way as domestic shipments, in accordance with the conditions defined in the Acts of the Union.
1.5 Dispatch of written correspondence: shipments specified in the Convention.
1.6 (Excluded)
1.6 bis Postal item: A general term referring to any item sent by a designated operator of a member country (dispatch of written correspondence, postal parcel, money transfer, etc.) as specified in the Universal Postal Convention, the Agreement on Postal Payment Services and their respective Regulations.
1.7 Designated Operator: any governmental or non-governmental organization officially designated by a member country to ensure the operation of postal services and the fulfillment of related obligations arising from Acts of the Union on its territory.
1.8 Reservation: This is a derogation provision in which a member country seeks to exclude or modify the legal effects of any provision of the Act (other than the Charter and General Regulations) in terms of application to that Member country. Any reservation must be compatible with the objectives and objectives of the Union, as defined in the preamble and Article one of the Charter. It must be duly substantiated and supported by the majority necessary for the approval of the relevant Act, and included in its Final Protocol.
Article III

Acts of the Union
1. The Charter is the basic act of the Union. It contains the main provisions of the Union and cannot be the subject of reservations.
2. The General Rules of Procedure consist of provisions ensuring the application of the Charter and the activities of the Union. It is binding on all Member States and cannot be subject to reservations.
3. The Universal Postal Convention and its Regulations include general rules applicable to the international postal service, as well as provisions on written correspondence and postal parcel services. These Acts are binding on all Member States. The member States monitor the fulfillment by their designated operators of the obligations arising from the Convention and its Regulations.
4. The agreements of the Union and their Regulations regulate services, other than written correspondence and postal parcel services, between the member countries that participate in them. They are mandatory only for these member countries. The signatory member States monitor the fulfillment by their designated operators of the obligations arising from the Agreements and their Regulations.
5. The Regulations, which contain the rules of application necessary for the implementation of the Convention and Agreements, are approved by the Postal Operations Council, taking into account the decisions of the Congress.
6. Possible Final Protocols attached to the Acts of the Union referred to in paragraphs 3-5 contain reservations to these Acts.
Article IV
Entry into force and duration of the Additional Protocol to the Charter of the Universal Postal Union
1. This Additional Protocol shall enter into force on January 1, 2018 and shall remain in force indefinitely.
In witness whereof, the plenipotentiaries of the Governments of the Member Countries have drawn up this Additional Protocol, which will have the same force and meaning as if its provisions had been incorporated into the text of the Charter itself, and signed it in a single copy, which shall be deposited with the Director General of the International Bureau. A copy of this copy will be provided to each party by the International Bureau of the Universal Postal Union.
