    To approve the memorandum of understanding in connection with the Treaty of May 26, 1972 on the limitation of missile defense systems between the Union of Soviet Socialist Republics and the United States of America, concluded in New York on September 26, 1997.

                    DUE TO THE MAY 26 TREATY

                        ABOUT THE AGREEMENTS

                             Memorandum    

        For the purposes of this memorandum, the Republic of Belarus, the Republic of Kazakhstan, the Russian Federation, Ukraine and the United States, referred to below as the right-holder States of the Union of Soviet Socialist Republics (USSR), in order to maintain strategic stability, recognizing the importance of maintaining the viability of the Treaty of May 26, 1972 on the limitation of missile defense systems between the Union of Soviet Socialist Republics and the United States, known below as the Treaty,        Recognizing changes in the political situation as a result of the formation of new independent states on the territory of the former USSR, in connection with the treaty agreed on the following:

 

                               Article I  

    At the time of entry into force of this memorandum, the parties to the Treaty are the Republic of Belarus, the Republic of Kazakhstan, the Russian Federation, Ukraine and the United States of America.

 

                               Article II  

    The states-holders of the rights of the USSR assume to them the rights and obligations of the former USSR under the Treaty and related documents.

 

                               Article III  

        Each of the states-holders of the right of the USSR-in relation to its territory and in relation to its own actions, fulfills the provisions of the Treaty, regardless of where this state carried out such actions independently or jointly with any other state.    

                               Article IV for the purposes of implementing the Treaty: a) the term "Union of Soviet Socialist Republics" means the states-holders of the rights of the USSR; b) the terms "national territory" and "territory of their country" mean the set of national territories of the states-holders of the rights of the USSR in relation to the former USSR, and the term "periphery of their national territory" refers to the former USSR, the periphery of the set of national territories of these states; and C) the term" capital", when it was used to refer to the capital of the Union of Soviet Socialist Republics in Article III of the Treaty and the protocol to it dated July 3, 1974, continues to mean the city of Moscow.    

                               Article V the right-holder state of the USSR or the right-holder States of the USSR may further use any object located on the territory of any state in which the provisions of this treaty are in force and are not parties to the treaty at this time, with the consent of such state and provided that the use of such object remains in accordance with the provisions of this treaty.    

                               Article VI states-holders of the rights of the USSR, all of them together, in accordance with the provisions of the Treaty and related documents, including The Protocols of July 3, 1974, are limited at any given moment to one area where the missile defense (RSF) system is located, and in total to no more than fifteen anti-missile launchers at the RSF test sites.    

                               Article VII the obligations contained in Article IX of the Treaty and the joint statement "G" in connection with the Treaty do not relate to transfers from one of the states-holders of the rights of the USSR to another such state and transfers between such states.    

                               Article VIII The Permanent Advisory Commission, referred to below as the Commission, shall operate in accordance with the Treaty and the memorandum of understanding between the Government of the Union of Soviet Socialist Republics and the Government of the United States of America on the establishment of the permanent advisory commission of December 21, 1972, as well as the regulation on the Commission, which reflects the multilateral nature of the Treaty and the equal legal status of the parties when making decisions in the Commission.    

                               Article IX 1.this memorandum is subject to ratification or ratification in accordance with the constitutional procedures of these states that have signed it.        2.the depositary of this memorandum is the Government of the United States of America.        3.this memorandum shall enter into force on the day of storage by the governments of all states that have signed it of documents on ratification or ratification of this Memorandum and shall be in force until the time remaining in force of the agreement.        4. Each of the states that have ratified or ratified this memorandum is bound by the provisions of the first agreed statement of September 26, 1997 in connection with the treaty between the Union of Soviet Socialist Republics and the United States of America on the restriction of missile attack defense systems of May 26, 1972, and the second agreed statement of September 26, 1997 in connection with the treaty between the Union of Soviet Socialist Republics and the United States of America on the restriction of missile attack defense systems of May 26, 1972.

    It was made in New York City on September 26, 1997 in five copies, each in Russian and English, and both texts have the same power.
