To ratify the Agreement on Cooperation between the Ministries of Defense of the member States of the Commonwealth of Independent States in the field of radiation, chemical and Biological Control, signed in Chisinau on November 14, 2008.

The Governments of the member States of the Commonwealth of Independent States, hereinafter referred to as the Parties, proceeding from the need to combine efforts to control the radiation, chemical and biological situation at the facilities of the Ministries of Defense of the States of the Parties.,

have agreed on the following:

Article 1

For the purposes of this Agreement, the following definitions are used: "radiationally, chemically and biologically dangerous facility" - an object where radioactive substances, toxic chemicals or biological agents are stored, processed, used or transported, in the event of an accident on which or during the destruction of which death or radioactive, chemical, or biological contamination of people may occur, farm animals and plants, as well as the natural environment; "object of the Ministry of Defense of the State of the Party" - a military unit or organization of the armed forces of the state of one of the Parties.

Article 2

The Parties shall cooperate in the field of monitoring the radiation, chemical and biological situation at the facilities of the Ministries of Defense of the States of the Parties by providing information on its changes and the threat of the spread of radioactive substances, toxic chemicals and biological agents in the territories of the States of the Parties. To this end, the Parties are creating a Joint System for monitoring and Assessing the Radiation, chemical and Biological Situation of the Ministries of Defense of the States of the Parties (hereinafter referred to as the Joint System). The principles of building a Unified System and performing its tasks are determined by the Regulations on the Unified System for Monitoring and Assessing the Radiation, Chemical and Biological Situation of the Ministries of Defense of the Member States of the Agreement on Cooperation between the Ministries of Defense of the Member States of the Commonwealth of Independent States in the Field of Radiation, Chemical and Biological Situation Control (hereinafter referred to as the Regulations on the Unified System), provided for in the annex to this Agreement. An agreement that is an integral part of it. The practical implementation of this Agreement is carried out by the Ministries of Defense of the States of the Parties.

Article 3

The integrated system is being created to solve the following tasks: ensuring continuous joint monitoring of the radiation, chemical and biological situation at the facilities of the Ministries of Defense of the States of the Parties; providing and receiving information on changes in the radiation, chemical and biological situation on the territory of the state of each of the Parties and the threat of the spread of radioactive substances, toxic chemicals and biological agents on the territory of the States of the other Parties; coordination of actions in planning, organizing and conducting joint events to notify troops (population) of changes in the radiation, chemical and biological situation on the territory of the State of each of the Parties and the threat of the spread of radioactive substances, toxic chemicals and biological agents on the territory of the States of the other Parties.

Article 4

In order to coordinate actions on the creation and improvement of a Unified System under the Council of Ministers of Defense of the member States of the Commonwealth of Independent States, a Coordinating Committee of the Chiefs of Troops of Radiation, Chemical and Biological Protection (chemical Protection) of the States of the Parties (hereinafter referred to as the Coordinating Committee) is being formed. In addition to the chiefs of the radiation, chemical and biological protection (chemical protection) troops of the States of the Parties, other officials of the States of the Parties may be included in the Coordination Committee as its members by agreement of the Parties. The Coordinating Committee acts in accordance with the Regulations on the Unified System.

Article 5

The organization of cooperation under this Agreement, including the procedure for the provision by the Parties of information on changes in the radiation, chemical and biological conditions at the facilities of the Ministries of Defense of the Parties and the threat of proliferation of radioactive substances, toxic chemicals and biological agents in the territories of the Parties, is determined by the Interaction Plan developed by the Coordinating Committee and approved by the Ministers of Defense of the Parties. The direct management of the forces and means of monitoring and assessing the radiation, chemical and biological situation of the Ministry of Defense of the State of one of the Parties is carried out by the chief of the radiation, chemical and biological protection (chemical protection) troops of the State of this Party, taking into account the approved Interaction Plan. The coordination of the actions of the forces and means of monitoring and assessing the radiation, chemical and biological situation of the Ministries of Defense of the States of the Parties is carried out by the Coordinating Committee.

Article 6

Information on changes in the radiation, chemical and biological situation on the territory of the State of each of the Parties and the threat of the spread of radioactive substances, toxic chemicals and biological agents on the territory of the States of the other Parties transmitted under this Agreement shall be used exclusively for the purposes of this Agreement. Information obtained during the implementation of this Agreement by one of the Parties may not be used by it to the detriment of the other Parties. The procedure for handling and protecting interstate secrets is carried out in accordance with the Agreement on Mutual Security of Interstate Secrets of January 22, 1993 or bilateral agreements on mutual protection of classified information (State secrets). The transfer of confidential information and its protection are carried out in accordance with the laws of the States of the Parties. The Parties have the right to take additional measures to protect information.

Article 7

The training of military specialists in the field of monitoring and assessment of radiation, chemical and biological conditions is carried out on the basis of bilateral agreements between the Parties.

Article 8

This Agreement does not affect the rights and obligations of the Parties arising from other international treaties.

Article 9

This Agreement shall enter into force on the date of the deposit of the third written notification to the depositary on the completion by the signatory Parties of the internal procedures necessary for its entry into force. For the Parties that have completed the internal procedures later, this Agreement shall enter into force from the date of receipt by the depositary of the relevant documents.

Article 10

By mutual agreement of the Parties, amendments may be made to this Agreement, which are formalized by separate protocols that enter into force in accordance with the procedure provided for the entry into force of this Agreement. Disagreements regarding the interpretation and application of the provisions of this Agreement are resolved through negotiations and consultations between the Parties.

Article 11

This Agreement is concluded for an indefinite period. Each Party may withdraw from this Agreement by sending a written notification to the depositary no later than six months before the date of withdrawal.

Article 12

This Agreement is open for accession by other member States of the Commonwealth of Independent States that share its goals and principles and are ready to assume obligations arising from this Agreement, and is considered to have entered into force for them from the date of receipt by the depositary of the notification of accession.

Done in Chisinau on November 14, 2008, in one original copy in Russian. The original copy is kept in the Executive Committee of the Commonwealth of Independent States, which will send a certified copy to each signatory State of this Agreement.

REGULATION on the Joint System for Monitoring and Assessment of the Radiation, Chemical and Biological Situation of the Ministries of Defense of the Member States of the Agreement on Cooperation between the Ministries of Defense of the Member States of the Commonwealth of Independent States States in the field of radiation, chemical and biological control

1. The Joint System for Monitoring and Assessment of the Radiation, Chemical and Biological Situation of the Ministries of Defense of the Member States of the Agreement on Cooperation between the Ministries of Defense of the Member States of the Commonwealth of Independent States in the Field of Radiation, Chemical and Biological Situation Control (hereinafter, respectively - The Joint System (Agreement) is created to ensure continuous monitoring of the state of the radiation, chemical and biological situation at radiation, chemical and biologically hazardous facilities of the Ministries of Defense of the States parties to the Agreement, as well as for prompt submission to the Governments of the States parties to the Agreement (hereinafter referred to as - Parties) and their military management bodies information on changes in the specified situation on the territory of the State of each of the Parties and the threat of the spread of radioactive substances, toxic chemicals and biological agents on the territory of the States of the other Parties. 2. The joint system includes forces and means of monitoring and assessing the radiation, chemical and biological situation of the Ministries of Defense of the States of the Parties (hereinafter referred to as the forces and means of the Ministries of Defense of the States of the Parties) to jointly solve tasks in their interests. The forces and means of the Joint System operate on a national basis and independently solve the tasks of monitoring and assessing the radiation, chemical and biological situation at the facilities of the Ministry of Defense of the State of each of the Parties. The integrated system consists of national systems for monitoring and assessing the radiation, chemical and biological situation of the Ministries of Defense of the States of the Parties, which are informationally linked to the Operational Coordination Center of the unified system for identifying and assessing the scale and consequences of the use of weapons of mass destruction, accidents (destruction) at radiation, chemical and biologically hazardous facilities of the Ministry of Defense of the Russian Federation. These national systems, in turn, include subsystems (links) of associations, formations of types and branches of the armed forces, as well as the corresponding military units of the armed forces of the States of the Parties. Subsystems include operational, tactical, and tactical units for monitoring and evaluating radiation, chemical, and biological conditions. The units consist of control points, forces and means of detecting nuclear explosions, radiation and chemical reconnaissance, and radiation, chemical and biological surveillance posts. Each of the Parties independently ensures the functioning of its national system for monitoring and assessing the radiation, chemical and biological situation. In the day-to-day operation of the Integrated System, round-the-clock performance of tasks related to monitoring and assessment of the radiation, chemical and biological situation is assigned to duty shifts of subsystems (units) for monitoring and assessment of the radiation, chemical and biological situation. The management of the on-duty forces and facilities of the Integrated System is carried out from the control points of the chiefs of the radiation, chemical and biological protection (chemical protection) troops of the States of the Parties. In the event of an emergency situation at a radiation, chemical or biologically hazardous facility of the Ministry of Defense of the State of the Party, which may affect a change in the radiation, chemical and biological situation in the territories of the States of the Parties, the tasks of monitoring and assessing the radiation, chemical and biological situation are carried out in cooperation with the forces and means of the Ministry of Defense of the State of this Party on based on the approved Interaction Plan. The joint actions of the forces and means of the Ministries of Defense of the States of the Parties are managed from the command post of the chief of the radiation, chemical and biological protection (chemical protection) troops of the State of the Party in whose territory these measures are carried out. 3. The coordination of joint actions of the forces and means of the Ministries of Defense of the States of the Parties is carried out by the Coordinating Committee of the Chiefs of the Radiation, Chemical and Biological Protection (Chemical Protection) Troops of the States of the Parties (hereinafter referred to as the Coordinating Committee). The regulation on the Coordination Committee is approved by the Council of Defense Ministers of the Member States of the Commonwealth of Independent States. Meetings of the Coordinating Committee are held as necessary, as a rule, once a year, alternately on the territory of one of the States of the Parties, determined by prior agreement between them. The costs of holding meetings of the Coordinating Committee shall be borne by the State of the Party in whose territory the meeting is being held. The costs of sending members of the Coordinating Committee shall be borne by the sending State. 4. The chairmanship of the Coordinating Committee is carried out in accordance with the Regulations on the Coordinating Committee. The Chairman of the Coordinating Committee is guided in his activities by the Agreement, the Regulation on the Coordinating Committee and the approved Interaction Plan. 5. Chairman of the Coordination Committee: coordinates the actions of the forces and means of the Ministries of Defense of the States of the Parties in carrying out joint tasks within the framework of the Agreement; together with the heads of the radiation, chemical and biological protection (chemical protection) troops of the States of the Parties, organizes the development and preparation of an Interaction Plan and submits it for approval to the Ministers of Defense of the States of the Parties; together with the heads of the radiation, chemical and biological protection (chemical protection) troops of the States of the Parties, organizes the development of proposals and recommendations for the further development and improvement of combat readiness the forces and means of monitoring and assessing the radiation, chemical and biological situation of the Ministries of Defense of the States of the Parties. 6. The management of the forces and means of the Integrated System in cooperation within the framework of the Agreement is carried out in Russian. 7. The admission of representatives of the radiation, chemical and biological protection (chemical protection) services of the States of the Parties to radiation, chemical and biologically hazardous facilities and facilities of the Ministries of Defense of the States of the Parties is carried out in accordance with the legislation of the state of each of the Parties.
