Article 12. Powers of the Central Election Commission of the Republic of the Constitutional Law on Elections in the Republic of Kazakhstan
Central Election Commission:
1) exercises control over the implementation of electoral legislation in the territory of the Republic; ensures its uniform application; makes decisions within its competence that are binding throughout the territory of the Republic;
2) organizes the preparation and conduct of elections of the President and deputies of the Mazhilis of Parliament; directs the organization and conduct of elections of deputies of the Senate of Parliament;
2-1) considers the issue of allowing political parties to participate in the elections of some deputies of the Mazhilis of Parliament and deputies of maslikhats elected on party lists;
2-2) form electoral districts for the election of deputies of the Mazhilis of Parliament in single-mandate territorial electoral districts and establish their boundaries, publish in the mass media a list of electoral districts and information about their boundaries;
3) excluded by the Constitutional Law of the Republic of Kazakhstan dated 06/19/2007 No. 268;
3-1) excluded by the Constitutional Law of the Republic of Kazakhstan dated 04/14/2004 No. 545;
4) prepare and submit to the Government of the Republic an approximate cost estimate for the conduct of the election campaign on the basis of budget applications submitted by the territorial election commissions, in accordance with the procedure determined by the Central Election Commission.;
5) manages election commissions for the election of the President, deputies of Parliament, and recall deputies of the Mazhilis of Parliament elected in single-mandate territorial electoral districts; cancels and suspends their decisions; distributes republican budget funds allocated for the election campaign among them; controls the creation of the necessary logistical conditions for the activities of election commissions; considers applications and complaints about decisions and actions (inaction) election commissions; organizes clarification of election legislation; organizes and conducts training for participants in the electoral process; conducts seminars with representatives of political parties and other participants in the electoral process on the organization and conduct of elections; carries out international cooperation in the field of electoral systems;
6) establishes the form and text of the ballot papers for the election of the President and deputies of the Mazhilis of Parliament according to party lists, the form of ballots for the election of deputies of the Senate of Parliament, deputies of the Mazhilis of Parliament elected in single-mandate territorial electoral districts, deputies of maslikhats, akims and members of other local governments, the procedure for their production, as well as the degree of security, forms of lists of voters (electors), a subscription list for collecting signatures of voters in support of presidential candidates, collecting signatures of electors in support of candidates for deputies of the Senate and for collecting signatures of voters in support of candidates for akims, other election documents, the shape of ballot boxes made of transparent voting material and samples of seals of election commissions, the procedure for storing election documents; ensures the production of ballots for the election of the President and deputies of Parliament;
6-1) organizes the production, determines the procedure for issuing and recording absentee ballots;
6-2) determines the procedure for making changes to the ballots in cases of withdrawal of candidacy, cancellation of the decision on nominating a candidate, cancellation of the decision on registration of candidates, party lists;
7) has the right to hear reports from state bodies and organizations on issues related to the preparation and conduct of elections, as well as information from public associations on compliance with election legislation;
8) registers candidates for President of the Republic, issues them appropriate certificates, and publishes a notice on the registration of candidates in the mass media;
9) informs voters about the course of the election campaign for the election of the President and members of Parliament, periodically publishes an information bulletin;
10) summarizes the results of the elections of the President and deputies of Parliament in the Republic as a whole, registers the elected President and deputies of Parliament, publishes a message about it in the mass media;
11) appoints and organizes repeated voting and repeat elections during the presidential election;
12) appoints repeated elections of deputies of Parliament;
13) appoints elections of members of Parliament to replace those who have retired;
14) appoints regular and early elections of maslikhats;
15) when organizing and conducting elections of deputies of maslikhats, akims and members of other local self-government bodies, monitor the compliance of the activities of territorial election commissions with the requirements of this Constitutional Law and, if violations of this Constitutional Law are detected, cancel their decisions.;
16) in accordance with the size of the population of administrative-territorial units, determines the number of deputies of maslikhats elected from them when forming a new convocation.;
16-1) post on the official Internet resource of the Central Election Commission regulatory legal acts on electoral legislation, information on the appointment and conduct of elections, as well as on the results of vote counting in the last elections.;
16-2) maintains the unified electronic Register of citizens – voters of the Republic of Kazakhstan;
16-3) when conducting elections using the electronic election system, conducts training for members of the relevant election commissions on its application.;
16-4) through the mass media, organizes training of the population on the use of the electronic electoral system in elections;
16-5) form consultative and advisory bodies;
16-6) determines the procedure for carrying out election campaigning and information support for the elections of the President of the Republic of Kazakhstan, deputies of Parliament, maslikhats of the Republic of Kazakhstan, akim, as well as members of other local self-government bodies;
16-7) purchases goods, works, and services for the creation, development, implementation, maintenance, administration, operation, and system maintenance of information and communication infrastructure facilities, an Internet resource, and logistical support for electoral activities from a subordinate organization in respect of which it carries out public administration;
16-8) approves the instructions for equipping the voting premises at the polling station, polling station;
16-9) approves the instructions for registration of authorized persons;
16-10) develops and approves the rules for the accreditation of public associations and non-profit organizations whose statutory activities include the conduct of election observation activities;
16-11) carries out the accreditation of republican public associations and non-profit organizations, whose statutory activities include the conduct of election observation activities;
16-12) develops and approves the rules for the purchase of goods, works and services necessary for the organization and operation of election commissions during the preparation and conduct of elections, referendums;
16-13) develops and approves qualification requirements for members of territorial election commissions;
17) exercises other powers in accordance with the legislation of the Republic of Kazakhstan.
