Article 50-1. Electronic electoral system of the Constitutional Law on Elections in the Republic of Kazakhstan

     1. When conducting elections, an electronic electoral system may be used to compile voter lists, vote, establish voting results and determine election results in the territory of an electoral district.

     When conducting elections using an electronic electoral system, the norms of this Constitutional Law are applied taking into account the specifics of using an electronic electoral system.

     2. An electronic electoral system is a set of information technologies, information networks and their software and hardware designed to automate information processes during the preparation and conduct of elections.

     The software and hardware used in the electronic election system must be certified in accordance with the legislation of the Republic of Kazakhstan.

     3. When conducting elections using the electronic electoral system, proxies, observers, and representatives of the mass media have the full scope of rights and obligations provided for by this Constitutional Law.

     4. The electoral districts and polling stations in which the electronic electoral system or its individual elements will be used shall be determined by the Central Election Commission.

     5. The equipment of the electronic election system is opened and installed in the presence of members of the precinct election commission at least three days before the voting day, and an act is drawn up.

     Authorized persons, observers and representatives of the mass media may be present at the opening and installation of the equipment.

     From the moment of installation of the electronic election system equipment, the security of the polling station is provided by employees of the internal affairs bodies.

     6. On the day of voting, from the moment of the opening of the polling station and until the transfer of the voting results to the Central Election Commission, local executive bodies ensure uninterrupted supply of electricity to the polling stations where electronic voting is conducted.

     7. The procedure for using the electronic electoral system in the part not regulated by this Constitutional Law shall be established by the Central Election Commission.
