Article 4. Universal suffrage of the Constitutional Law on Elections in the Republic of Kazakhstan

Article 4. Universal suffrage of the Constitutional Law on Elections in the Republic of Kazakhstan

     1. Universal active suffrage is the right of citizens of the Republic to vote in elections upon reaching the age of eighteen, regardless of origin, social, official and property status, gender, race, nationality, language, attitude to religion, beliefs, place of residence or any other circumstances.

     2. Passive suffrage is the right of citizens of the Republic of Kazakhstan to be elected President, deputy of Parliament, maslikhat, akim or a member of another local government body.

     3. Citizens who have been declared legally incompetent by a court, as well as those who are being held in places of deprivation of liberty by a court verdict, do not participate in elections.

     4. May not be a candidate for President of the Republic of Kazakhstan, for deputies of the Parliament of the Republic of Kazakhstan, maslikhats, akims, as well as a candidate for members of another local government body.:

     1) a person who has a criminal record that has not been expunged or removed in accordance with the procedure established by law;

     2) a person whose guilt in committing a corruption offense and a corruption offense has been recognized by a court in accordance with the procedure established by law.

     By the Normative resolution of the Constitutional Court of the Republic of Kazakhstan dated 09/20/2023 No. 28-NP, subparagraph 2) of paragraph 4 of Article 4 of this Constitutional Law of the Republic of Kazakhstan is recognized as corresponding to the Constitution of the Republic of Kazakhstan.
