Article 49. Appeal and cancellation of decisions and actions during the election campaign of the Constitutional Law on Elections in the Republic of Kazakhstan

 

     Courts and prosecutor's offices are required to accept applications from members of election commissions, citizens, and representatives of public associations registered in accordance with the procedure established by law regarding voting issues, including violations of election legislation, received during the preparation and conduct of elections, and consider them within five days, and those received less than five days before voting. and on the day of voting – immediately, unless otherwise provided by this Constitutional Law.

     Decisions and actions of local government and self-government bodies, enterprises and organizations, and their officials that violate election laws are appealed in court.

     Courts, prosecutor's offices, and election commissions organize their work during the electoral process, including on weekends and on election day, in such a way as to ensure that complaints are received and considered within the time limits established by this Constitutional Law.

     Applications of citizens and organizations on violations of electoral legislation are considered by election commissions within five days from the date of receipt of the complaint, unless otherwise provided by this Constitutional Law.

     Complaints about decisions and actions (inaction) The election commission and its members are considered by a higher commission within three days from the date of receipt of the complaint, unless otherwise provided by this Constitutional Law.
